AN ACT

 

amending sections 16-166, 16-411, 16-541, 16-579 and 28-3153, Arizona Revised Statutes; relating to voting.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, section 16-166, Arizona Revised Statutes, is amended to read:

START_STATUTE16-166.  Verification of registration

A.  Except for the mailing of sample ballots, a county recorder who mails an item to any elector shall send the mailing by nonforwardable first class mail marked with the statement required by the postmaster to receive an address correction notification.  If the item is returned undelivered, the county recorder shall send a follow‑up notice to that elector within three weeks of receipt of the returned notice.  The county recorder shall send the follow‑up notice to the address that appears in the general county register or to the forwarding address provided by the United States postal service.  The follow‑up notice shall include an appropriate internet address for revising voter registration information or a registration form and the information prescribed by section 16‑131, subsection C and shall state that if the elector does not complete and return a new registration form with current information to the county recorder or make changes to the elector's voter registration information that is maintained online within thirty‑five days, the elector's registration status shall be changed from active to inactive.

B.  If the elector provides the county recorder with a new registration form or otherwise revises the elector's information, the county recorder shall change the general register to reflect the changes indicated on the new registration.  If the elector indicates a new residence address outside that county, the county recorder shall forward the voter registration form or revised information to the county recorder of the county in which the elector's address is located.  If the elector provides a new residence address that is located outside this state, the county recorder shall cancel the elector's registration.

C.  The county recorder shall maintain on the inactive voter list the names of electors who have been removed from the general register pursuant to subsection A or E of this section for a period of four years or through the date of the second general election for federal office following the date of the notice from the county recorder that is sent pursuant to subsection E of this section.

D.  On notice that a government agency has changed the name of any street, route number, post office box number or other address designation, the county recorder shall revise the registration records and shall send a new verification of registration notice to the electors whose records were changed.

E.  The county recorder on or before May 1 of each year preceding a state primary and general election or more frequently as the recorder deems necessary may use the change of address information supplied by the postal service through its licensees to identify registrants whose addresses may have changed.  If it appears from information provided by the postal service that a registrant has moved to a different residence address in the same county, the county recorder shall change the registration records to reflect the new address and shall send the registrant a notice of the change by forwardable mail and a postage prepaid preaddressed return form or an appropriate internet address for revising voter registration information by which the registrant may verify or correct the registration information.  If the registrant fails to revise the information or return the form postmarked not later than thirty-five days after the mailing of the notice, the elector's registration status shall be changed from active to inactive.  If the notice sent by the recorder is not returned, the registrant may be required to provide affirmation or confirmation of the registrant's address in order to vote.  If the registrant does not vote in an election during the period after the date of the notice from the recorder through the date of the second general election for federal office following the date of that notice, the registrant's name shall be removed from the list of inactive voters.  If the registrant has changed residence to a new county, the county recorder shall provide information on how the registrant can continue to be eligible to vote.

F.  The county recorder shall reject any application for registration that is not accompanied by satisfactory evidence of United States citizenship.  Satisfactory evidence of citizenship shall include any of the following:

1.  The number of the applicant's driver license or nonoperating identification license issued after October 1, 1996 by the department of transportation or the equivalent governmental agency of another state within the United States if the agency indicates on the applicant's driver license or nonoperating identification license that the person has provided satisfactory proof of United States citizenship.

2.  A legible photocopy of the applicant's birth certificate that verifies citizenship to the satisfaction of the county recorder.

3.  A legible photocopy of pertinent pages of the applicant's United States passport identifying the applicant and the applicant's passport number or presentation to the county recorder of the applicant's United States passport.

4.  A presentation to the county recorder of the applicant's United States naturalization documents or the number of the certificate of naturalization.  If only the number of the certificate of naturalization is provided, the applicant shall not be included in the registration rolls until the number of the certificate of naturalization is verified with the United States immigration and naturalization service citizenship and immigration services by the county recorder.

5.  Other documents or methods of proof that are established pursuant to the immigration reform and control act of 1986.

6.  The applicant's bureau of Indian affairs card number, tribal treaty card number or tribal enrollment number.

7.  an identification card that is issued by this state or the United States.

G.  Notwithstanding subsection F of this section, any person who is registered in this state on the effective date of this amendment to this section is deemed to have provided satisfactory evidence of citizenship and shall not be required to resubmit evidence of citizenship unless the person is changing voter registration from one county to another.

H.  For the purposes of this section, proof of voter registration from another state or county is not satisfactory evidence of citizenship.

I.  A person who modifies voter registration records with a new residence ballot shall not be required to submit evidence of citizenship.  After citizenship has been demonstrated to the county recorder, the person is not required to resubmit satisfactory evidence of citizenship in that county.

J.  After a person has submitted satisfactory evidence of citizenship, the county recorder shall indicate this information in the person's permanent voter file.  After two years the county recorder may destroy all documents that were submitted as evidence of citizenship.END_STATUTE

Sec. 2.  Section 16-411, Arizona Revised Statutes, is amended to read:

START_STATUTE16-411.  Designation of election precincts and polling places; voting centers; electioneering; wait times

A.  The board of supervisors of each county, on or before October 1 of each year preceding the year of a general election, by an order, shall establish a convenient number of election precincts in the county and define the boundaries of the precincts.  The election precinct boundaries shall be so established so as to be included within election districts prescribed by law for elected officers of the state and its political subdivisions including community college district precincts, except those elected officers provided for in titles 30 and 48.  Election precinct lines shall also be drawn to include as a priority public elementary, middle and HIGH schools within an election precinct.

B.  Not less than At least twenty days before a general or primary election, and at least ten days before a special election, the board shall designate one polling place within each precinct where the election shall be held, except that:

1.  On a specific finding of the board, included in the order or resolution designating polling places pursuant to this subsection, that no suitable polling place is available within a precinct, a polling place for that precinct may be designated within an adjacent precinct.

2.  Adjacent precincts may be combined if boundaries so established are included in election districts prescribed by law for state elected officials and political subdivisions including community college districts but not including elected officials prescribed by titles 30 and 48.  The officer in charge of elections may also split a precinct for administrative purposes.  The polling places shall be listed in separate sections of the order or resolution.

3.  2.  On a specific finding of the board that the number of persons who are listed as permanent early voters pursuant to section 16‑544 is likely to substantially reduce the number of voters appearing at one or more specific polling places at that election, adjacent precincts may be consolidated by combining polling places and precinct boards for that election.  The board of supervisors shall ensure that a reasonable and adequate number of polling places will be designated for that election.  Any consolidated polling places shall be listed in separate sections of the order or resolution of the board.

4.  3.  On a specific resolution of the board, the board may shall authorize the use of voting centers in place of or in addition to specifically designated polling places for thirty days before the day of the election.  A voting center shall allow any voter in that county to receive the appropriate ballot for that voter on election day after presenting identification as prescribed in section 16‑579 and to lawfully cast the ballot.  Voting centers may shall be established in coordination and consultation with the county recorder, at other county offices or at other locations in the county deemed appropriate including federal government facilities.  A county with a POPULATION of less THAN two hundred thousand persons shall have a maximum of four voting centers, a county with a POPULATION of TWO hundred THOUSAND persons or more and less than one million PERSONS shall have a maximum of eight voting centers and a county with a POPULATION of one million persons or more shall have a maximum of fifteen voting centers, as determined by the board of SUPERVISORS.

5.  4.  On a specific resolution of the board of supervisors that is limited to a specific election date and that is voted on by a recorded vote, the board may authorize the county recorder or other officer in charge of elections to use emergency voting centers as follows:

(a)  The board shall specify in the resolution the location and the hours of operation of the emergency voting centers.

(b)  A qualified elector voting at an emergency voting center shall provide identification as prescribed in section 16‑579, except that notwithstanding section 16‑579, subsection A, paragraph 2, for any voting at an emergency voting center, the county recorder or other officer in charge of elections may allow a qualified elector to update the elector's voter registration information as provided for in the secretary of state's instructions and procedures manual adopted pursuant to section 16‑452.

(c)  If an emergency voting center established pursuant to this section becomes unavailable and there is not sufficient time for the board of supervisors to convene to approve an alternate location for that emergency voting center, the county recorder or other officer in charge of elections may make changes to the approved emergency voting center location and shall notify the public and the board of supervisors regarding that change as soon as practicable.  The alternate emergency voting center shall be as close in proximity to the approved emergency voting center location as possible.

C.  If the board fails to designate the place for holding the election, or if it cannot be held at or about the place designated, the justice of the peace in the precinct, two days before the election, by an order, copies of which the justice of the peace shall immediately post in three public places in the precinct, shall designate the place within the precinct for holding the election.  If there is no justice of the peace in the precinct, or if the justice of the peace fails to do so, the election board of the precinct shall designate and give notice of the place within the precinct of holding the election.  For any election in which there are no candidates for elected office appearing on the ballot, the board may consolidate polling places and precinct boards and may consolidate the tabulation of results for that election if all of the following apply:

1.  All affected voters are notified by mail of the change at least thirty‑three days before the election.

2.  Notice of the change in polling places includes notice of the new voting location, notice of the hours for voting on election day and notice of the telephone number to call for voter assistance.

3.  All affected voters receive information on early voting that includes the application used to request an early voting ballot.

D.  The board is not required to designate a polling place for special district mail ballot elections held pursuant to article 8.1 of this chapter, but the board may designate one or more sites for voters to deposit marked ballots until 7:00 p.m. on the day of the election.

E.  Except as provided in subsection F of this section, A public school shall provide sufficient space for use as a polling place for any city, county or state election when requested by the officer in charge of elections.  The department of education and the governing boards of school districts shall assist in the SELECTION of polling places and shall provide to the county board of supervisors by May 15 in every even‑numbered year a list of available polling place locations.

F.  The principal of the school may deny a request to provide space for use as a polling place for any city, county or state election if, within two weeks after a request has been made, the principal provides a written statement indicating a reason the election cannot be held in the school, including any of the following:

1.  Space is not available at the school.

2.  The safety or welfare of the children would be jeopardized.

G.  F.  The board shall make available to the public as a public record a list of the polling places for all precincts in which the election is to be held.

H.  G.  Except in the case of an emergency, any facility that is used as a polling place on election day or that is used as an early voting site during the period of early voting shall allow persons to electioneer and engage in other political activity outside of the seventy‑five foot limit prescribed by section 16‑515 in public areas and parking lots used by voters.  This subsection shall does not be construed to permit allow the temporary or permanent construction of structures in public areas and parking lots or the blocking or other impairment of access to parking spaces for voters.  The county recorder or other officer in charge of elections shall post on its website at least two weeks before election day a list of those polling places in which emergency conditions prevent electioneering and shall specify the reason the emergency designation was granted and the number of attempts that were made to find a polling place before granting an emergency designation.  If the polling place is not on the website list of polling places with emergency designations, electioneering and other political activity shall be permitted allowed outside of the seventy‑five foot limit.  If an emergency arises after the county recorder or other officer in charge of elections' initial website posting, the county recorder or other officer in charge of elections shall update the website as soon as is practicable to include any new polling places, shall highlight the polling place location on the website and shall specify the reason the emergency designation was granted and the number of attempts that were made to find a polling place before granting an emergency designation.

I.  H.  For the purposes of this section, a county recorder or other officer in charge of elections shall designate a polling place as an emergency polling place and thus prohibit persons from electioneering and engaging in other political activity outside of the seventy‑five foot limit prescribed by section 16‑515 but inside the property of the facility that is hosting the polling place if any of the following occurs:

1.  An act of God renders a previously set polling place as unusable.

2.  A county recorder or other officer in charge of elections has exhausted all options and there are no suitable facilities in a precinct that are willing to be a polling place unless a facility can be given an emergency designation.

J.  I.  The secretary of state shall provide through the instructions and procedures manual adopted pursuant to section 16‑452 the maximum allowable wait time for any election that is subject to section 16‑204 and provide for a method to reduce voter wait time at the polls in the primary and general elections.  The method shall consider at least all of the following for primary and general elections in each precinct:

1.  The number of ballots voted in the prior primary and general elections.

2.  The number of registered voters who voted early in the prior primary and general elections.

3.  The number of registered voters and the number of registered voters who cast an early ballot for the current primary or general election.

4.  The number of election board members and clerks and the number of rosters that will reduce voter wait time at the polls. END_STATUTE

Sec. 3.  Section 16-541, Arizona Revised Statutes, is amended to read:

START_STATUTE16-541.  Early voting

A.  Any election called pursuant to the laws of this state shall provide for early voting.  Any qualified elector may vote by early ballot in person at any polling place.  A qualified elector may vote by mail only if the elector is physically unable to cast a ballot within the period for early voting, or has a physical disability, is confined to a nursing home or other similar facility, is on military duty or is temporarily residing outside this state.

B.  A qualified elector of a special district organized pursuant to title 48 shall be permitted to vote early in any special district mail ballot election as provided in article 8.1 of this chapter. END_STATUTE

Sec. 4.  Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, section 16-579, Arizona Revised Statutes, is amended to read:

START_STATUTE16-579.  Procedure for obtaining ballot by elector

A.  Every qualified elector, before receiving a ballot, shall announce the elector's name and place of residence in a clear, audible tone of voice to the election official in charge of the signature roster or present the elector's name and residence in writing.  The election official in charge of the signature roster shall comply with the following and the qualified elector shall be allowed within the voting area:

1.  The elector shall present any of the following:

(a)  only a valid form of identification that bears the photograph, name and address of the elector that reasonably appear to be the same as the name and address in the precinct register, including an Arizona driver license, an Arizona nonoperating identification license, a tribal enrollment card or other form of tribal identification or a United States federal, state or local government issued identification.  Identification is deemed valid unless it can be determined on its face that it has expired.

(b)  Two different items that contain the name and address of the elector that reasonably appear to be the same as the name and address in the precinct register, including a utility bill, a bank or credit union statement that is dated within ninety days of the date of the election, a valid Arizona vehicle registration, an Arizona vehicle insurance card, an Indian census card, tribal enrollment card or other form of tribal identification, a property tax statement, a recorder's certificate, a voter registration card, a valid United States federal, state or local government issued identification or any mailing that is labeled as "official election material".  Identification is deemed valid unless it can be determined on its face that it has expired.

(c)  A valid form of identification that bears the photograph, name and address of the elector except that if the address on the identification does not reasonably appear to be the same as the address in the precinct register or the identification is a valid United States military identification card or a valid United States passport and does not bear an address, the identification must be accompanied by one of the items listed in subdivision (b) of this paragraph.

2.  If the elector does not present identification that complies with paragraph 1 of this subsection, the elector is only eligible to vote a provisional ballot as prescribed by section 16‑584 or a conditional provisional ballot as provided for in the secretary of state's instruction and procedures manual adopted pursuant to section 16‑452.

B.  Any qualified elector who is listed as having applied for an early ballot but who states that the elector has not voted and will not vote an early ballot for this election or surrenders the early ballot to the precinct inspector on election day shall be allowed to vote pursuant to the procedure set forth in section 16‑584.

C.  Each qualified elector's name shall be numbered consecutively by the clerks and in the order of applications for ballots.  The judge shall give the qualified elector only one ballot, and the elector's name shall be immediately checked on the precinct register.

D.  For precincts in which a paper signature roster is used, each qualified elector shall sign the elector's name in the signature roster prior to receiving a ballot, but an inspector or judge may sign the roster for an elector who is unable to sign because of physical disability, and in that event the name of the elector shall be written with red ink, and no attestation or other proof shall be necessary.  The provisions of this subsection relating to signing the signature roster shall not apply to electors casting a ballot using early voting procedures.

E.  For precincts in which an electronic poll book system is used, each qualified elector shall sign the elector's name as prescribed in the instructions and procedures manual adopted by the secretary of state pursuant to section 16‑452 before receiving a ballot, but an inspector or judge may sign the roster for an elector who is unable to sign because of physical disability, and in that event the name of the elector shall be written with the inspector's or judge's attestation on the same signature line.

F.  A person offering to vote at a special district election for which no special district register has been supplied shall sign an affidavit stating the person's address and that the person resides within the district boundaries or proposed district boundaries and swearing that the person is a qualified elector and has not already voted at the election being held.END_STATUTE

Sec. 5.  Section 28-3153, Arizona Revised Statutes, is amended to read:

START_STATUTE28-3153.  Driver license issuance; prohibitions

A.  The department shall not issue the following:

1.  A driver license to a person who is under eighteen years of age, except that the department may issue:

(a)  A restricted instruction permit for a class D or G license to a person who is at least fifteen years of age.

(b)  An instruction permit for a class D, G or M license as provided by this chapter to a person who is at least fifteen years and six months of age.

(c)  A class G or M license as provided by this chapter to a person who is at least sixteen years of age.

2.  A class D, G or M license or instruction permit to a person who is under eighteen years of age and who has been tried in adult court and convicted of a second or subsequent violation of criminal damage to property pursuant to section 13‑1602, subsection A, paragraph 1 or convicted of a felony offense in the commission of which a motor vehicle is used, including theft of a motor vehicle pursuant to section 13‑1802, unlawful use of means of transportation pursuant to section 13‑1803 or theft of means of transportation pursuant to section 13‑1814, or who has been adjudicated delinquent for a second or subsequent act that would constitute criminal damage to property pursuant to section 13‑1602, subsection A, paragraph 1 or adjudicated delinquent for an act that would constitute a felony offense in the commission of which a motor vehicle is used, including theft of a motor vehicle pursuant to section 13‑1802, unlawful use of means of transportation pursuant to section 13‑1803 or theft of means of transportation pursuant to section 13‑1814, if committed by an adult.

3.  A class A, B or C license to a person who is under twenty‑one years of age, except that the department may issue a class A, B or C license that is restricted to only intrastate driving to a person who is at least eighteen years of age.

4.  A license to a person whose license or driving privilege has been suspended, during the suspension period.

5.  Except as provided in section 28‑3315, a license to a person whose license or driving privilege has been revoked.

6.  A class A, B or C license to a person who has been disqualified from obtaining a commercial driver license.

7.  A license to a person who on application notifies the department that the person is an alcoholic as defined in section 36‑2021 or a drug dependent person as defined in section 36‑2501, unless the person submits a medical examination report that includes a current evaluation from a substance abuse counselor indicating that, in the opinion of the counselor, the condition does not affect or impair the person's ability to safely operate a motor vehicle.

8.  A license to a person who has been adjudged to be incapacitated pursuant to section 14‑5304 and who at the time of application has not obtained either a court order that allows the person to drive or a termination of incapacity as provided by law.

9.  A license to a person who is required by this chapter to take an examination unless the person successfully passes the examination.

10.  A license to a person who is required under the motor vehicle financial responsibility laws of this state to deposit proof of financial responsibility and who has not deposited the proof.

11.  A license to a person if the department has good cause to believe that the operation of a motor vehicle on the highways by the person would threaten the public safety or welfare.

12.  A license to a person whose driver license has been ordered to be suspended for failure to pay child support, except that a noncommercial restricted license may be issued pursuant to section 25‑518.

13.  A class A, B or C license to a person whose license or driving privilege has been canceled until the cause for the cancellation has been removed.

14.  A class A, B or C license or instruction permit to a person whose state of domicile is not this state.

15.  A class A, B or C license to a person who fails to demonstrate proficiency in the English language as determined by the department.

B.  The department shall not issue a driver license to or renew the driver license of the following persons:

1.  A person about whom the court notifies the department that the person violated the person's written promise to appear in court when charged with a violation of the motor vehicle laws of this state until the department receives notification in a manner approved by the department that the person appeared either voluntarily or involuntarily or that the case has been adjudicated, that the case is being appealed or that the case has otherwise been disposed of as provided by law.

2.  If notified pursuant to section 28‑1601, a person who fails to pay a civil penalty as provided in section 28‑1601, except for a parking violation, until the department receives notification in a manner approved by the department that the person paid the civil penalty, that the case is being appealed or that the case has otherwise been disposed of as provided by law.

C.  The magistrate or the clerk of the court shall provide the notification to the department prescribed by subsection B of this section.

D.  Notwithstanding any other law, the department shall not issue to or renew a driver license or nonoperating identification license for a person who does not submit proof satisfactory to the department that the applicant's presence in the United States is authorized under federal law as PRESCRIBED by subsection E of this section.  For an application for a driver license or a nonoperating identification license, the department shall not accept as a primary source of identification a driver license issued by a state if the state does not require that a driver licensed in that state be lawfully present in the United States under federal law.  The director shall adopt rules necessary to carry out the purposes of this subsection.  The rules shall include procedures for:

1.  Verification that the applicant's presence in the United States is authorized under federal law.

2.  Issuance of a temporary driver permit pursuant to section 28‑3157 pending verification of the applicant's status in the United States.

E.  An applicant shall submit all of the following:

1.  Proof of identity by presenting an ORIGINAL or certified copy of a United States passport or birth certificate.

2.  Proof of a social SECURITY number by presenting an ORIGINAL or copy of a social security card or W-2 form.

3.  Proof of residency in this state in two forms, such as a utility bill or bank statement.END_STATUTE

Sec. 6.  Requirements for enactment; three-fourths vote

Pursuant to article IV, part 1, section 1, Constitution of Arizona, sections 16-166 and 16-579, Arizona Revised Statutes, as amended by this act, are effective only on the affirmative vote of at least three-fourths of the members of each house of the legislature.
