AN ACT
amending title 49, chapter 1, Arizona Revised Statutes, by adding article 8; relating to carbon dioxide emissions.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 49, chapter 1, Arizona Revised Statutes, is amended by adding article 8, to read:
ARTICLE 8. CARBON DIOXIDE EMISSIONS
STATE IMPLEMENTATION PLAN
49-193. Definitions
In this article, unless the context otherwise requires:
1. "Covered electric generating unit" means an existing fossil fuel‑fired electric generating unit within this state that is subject to regulation under the federal emission guidelines.
2. "Federal emission guidelines" means any final rules, regulations, guidelines or other requirements that the united states environmental protection agency may adopt for regulating carbon dioxide emissions from covered electric generating units under section 111 of the clean air act as defined in section 49‑401.01.
49-193.01. State implementation plan; carbon dioxide emissions; report
A. If the department elects to develop a state implementation plan for regulating carbon dioxide emissions from covered electric generating units, the department shall provide notice and an opportunity to comment on the plan and shall consider the findings of the report prepared pursuant to subsection b of this section.
B. In developing the state implementation plan prescribed in subsection A of this section, the department shall prepare an economic impact report subject to notice and comment that assesses the effects of the State plan on the following:
1. The electric power sector, including:
(a) The ability of this state to provide affordable electricity through diversified sources of electricity generation.
(b) The type and amount of electric generating capacity within this State that is likely to retire or switch to another fuel.
(c) The amount of investment necessary to offset retirements of electric generating capacity and maintain generation reserve margins.
(d) Potential risks to electric reliability, including resource adequacy risks and transmission constraints.
2. Electricity consumers within this state, including any disproportionate impacts of electricity and other energy price increases on middle-income and lower-income households.
3. Employment within this state, including direct and indirect employment effects and jobs lost within affected sectors of this state's economy.
4. Economic development within this state, including effects on manufacturing, commercial and other sectors of this State's economy.
5. The competitive position of this State relative to neighboring States and other economic competitors.
6. State and local governments, including potential impacts resulting from changes in tax revenues.
7. State law, including any new laws necessary to implement the State plan.
