AN ACT

 

amending title 13, chapter 38, Arizona Revised Statutes, by adding article 35; relating to law enforcement officers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 13, chapter 38, Arizona Revised Statutes, is amended by adding article 35, to read:

ARTICLE 35.  LAW ENFORCEMENT OFFICER

USE OF FORCE INVESTIGATIONS

START_STATUTE13-4295.  Law enforcement officer; use of deadly force; outside investigators; report

A.  If a law enforcement officer uses deadly physical force in the performance of the officer's official duties and that use causes the death of another person, an investigator or law enforcement officer who is not from the same law enforcement agency as the officer or the county attorney from another county shall conduct the investigation into the officer's use of deadly physical force.

B.  The investigator, law enforcement officer or county attorney who completes the investigation shall provide the results of the investigation to the county attorney of the county in which the use of deadly physical force occurred. END_STATUTE
