AN ACT
Amending title 41, chapter 7, article 12, Arizona Revised Statutes, by adding section 41-1293; relating to the legislature.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Heading change
The article heading of title 41, chapter 7, article 12, Arizona Revised Statutes, is changed from "joint legislative committees" to "committees related to the legislature".
Sec. 2. Title 41, chapter 7, article 12, Arizona Revised Statutes, is amended by adding section 41-1293, to read:
41-1293. Commission on review of laws; membership; duties; annual report
A. The commission on review of laws is established consisting of the following members:
1. three members who are appointed by the governor.
2. Two members who are appointed by the president of the senate.
3. Two members who are appointed by the speaker of the house of representatives.
4. Two members who are appointed by the chief justice of the supreme court.
B. The officials making appointments pursuant to subsection a of this section shall ensure that membership of the commission includes REPRESENTATIVES of all areas of the criminal justice system, including prosecutors, defense attorneys, judges and legal scholars.
C. The governor shall designate one member of the commission to serve as the Chairperson.
D. The commission shall meet at the call of the chairperson.
E. commission Members are not eligible to receive compensation or reimbursement of expenses.
F. The commission shall:
1. study and review all penal laws of this state, other THan CRIMINAL offenses, that involve illicit controlled SUBSTANCES or that RELATE to the operation of motor vehicles.
2. make RECOMMENDATIONS to the legislature regarding the repeal or revision of any laws that the commission identifies as UNNECESSARY, unclear, duplicative, overly broad, outdated or otherwise insufficient to serve the intended purpose of the law.
3. On or before November 1 of each year, report its findings and recommendations to the governor, the president of the senate, the speaker of the house of representatives, the chief justice of the supreme court and the standing committees of the senate and the house of representatives and with primary jurisdiction over criminal justice.
G. The standing committees in the senate and the house of representatives with primary jurisdiction over criminal justice matters shall recommend A bill to enact the commission's recommendations.
H. The Supreme Court shall direct the lower courts of this state to determine if any living person is serving or has served a sentence, owes or has paid fines or fees related to laws that the commission has been determined to be unnecessary, unclear, duplicative, overly broad, outdated or otherwise insufficient to serve the intended purpose of the law and the court shall expunge the record of any such person.
