AN ACT

 

Amending title 8, chapter 2, article 2, Arizona Revised Statutes, by adding section 8-223; relating to children.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 8, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 8-223, to read:

START_STATUTE8-223. Waiver

In any action that may lead to the termination of parental rights, the court may allow a parent or guardian to withdraw an admission or plea of no contest if the withdrawal is necessary to correct a manifest injustice.  On withdrawal of the admission or plea, the parent or guardian regains the right to trial and any findings based on the admission or plea are negated.
