AN ACT

 

Amending title 32, chapter 18, article 3, Arizona Revised Statutes, by adding section 32‑1979.04; relating to the Arizona state board of pharmacy.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 32, chapter 18, article 3, Arizona Revised Statutes, is amended by adding section 32-1979.04, to read:

START_STATUTE32-1979.04.  Prescribing and administering treatments; board rules; department of health services rules

A.  Except as provided in subsection G of this section, a pharmacist who is licensed pursuant to this chapter and who meets the requirements of this section may prescribe and administer the following to a person who is six years of age or older pursuant to the rules and protocols adopted by the board and consistent with national guidelines:

1.  A Tuberculin skin test and interpret the results for the purposes of referring a patient for treatment for a positive test.

2.  Prescription medications approved by the United States food and drug administration for an eligible patient who tests positive for influenza or strep throat.

3.  United States food and drug administration‑approved nonsedating and low‑sedating antihistamines, corticosteroids, decongestants, saline, cromolyn sodium and leukotriene receptor antagonists.

4.  Extend routine, chronic medications that are not controlled substances for an additional thirty to sixty days.

B.  A pharmacist who wishes to prescribe and administer treatments pursuant to this section must be board certified and meet all board requirements as prescribed in rule.

C.  A pharmacist who prescribes a treatment pursuant to this section shall:

1.  Report the administration to the person's primary care provider or physician, if the primary care provider or physician is available, within forty‑eight hours after prescribing the treatment.

2.  Maintain a record of the treatment.

D.  This section does not establish a cause of action against a person's primary care provider or physician for any adverse reaction, complication or negative outcome arising from administering any immunization, vaccine or emergency medication by a pharmacist to a patient pursuant to this section if it is administered without a prescription written by the patient's primary care provider or physician.

E.  The board shall adopt rules for prescribing and administering treatments pursuant to this section regarding:

1.  Recordkeeping and reporting requirements.

2.  Requirements and qualifications for pharmacist certification pursuant to this section.

3.  Completing patient self‑assessments if deemed appropriate by the board before prescribing or administering treatments pursuant to this section.

F.  The department of health services, by rule, shall establish and maintain a list of treatments, in addition to those prescribed in statute, that may be administered by a pharmacist only pursuant to a prescription order.  for the purposes of this subsection, the department is exempt from the rulemaking requirements of title 41, chapter 6.  The department shall adopt its initial rules under this subsection within six months after the effective date of this section and shall hold one public hearing before adopting the rules.

G.  A pharmacist may not prescribe or administer a treatment pursuant to this section to a minor without the written consent of the minor's parent or guardian. END_STATUTE
