AN ACT

 

Amending title 32, chapter 32, article 1, Arizona Revised Statutes, by adding section 32‑3219; relating to health professionals.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 32, chapter 32, article 1, Arizona Revised Statutes, is amended by adding section 32-3219, to read:

START_STATUTE32-3219.  Sexual orientation change efforts; unprofessional conduct; definitions

A.  It is an act of unprofessional conduct for a mental health provider to engage in sexual orientation change efforts with a patient who is under eighteen years of age.  The mental health provider is subject to disciplinary action by the appropriate regulatory board for a violation of this subsection.

B.  For the purposes of this section:

1.  "Mental health provider" means a physician who is licensed pursuant to chapter 13 of this title and who specializes in the practice of psychiatry, a psychologist who is licensed pursuant to chapter 19.1 of this title or a behavioral health professional who is licensed pursuant to chapter 33 of this title.

2.  "Sexual orientation change efforts":

(a)  Means a practice by a mental health provider that seeks to change a patient's sexual orientation and includes efforts to change the patient's behaviors or gender expressions or to eliminate or reduce the patient's sexual or romantic attractions or feelings toward individuals of the same sex.

(b)  Does not include psychotherapies that either:

(i)  Provide acceptance, support and understanding of a patient or the facilitation of a patient's coping skills, social support or identity exploration and development, including neutral sexual orientation interventions to prevent or address unlawful conduct or unsafe sexual practices.

(ii)  Do not seek to change a patient's sexual orientation. END_STATUTE
