AN ACT

 

Amending title 11, chapter 2, article 4, Arizona Revised Statutes, by adding section 11-269.20; relating to drug addiction treatment.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 11, chapter 2, article 4, Arizona Revised Statutes, is amended by adding section 11-269.20, to read:

START_STATUTE11-269.20.  Angel initiative program; drug addiction treatment; placement; standards; prosecution prohibited

A.  In conjunction with the governor's office of youth, faith and family, or its successor office, each county shall establish in the county seat an angel initiative program that allows persons to surrender controlled substances or drug paraphernalia to a local police precinct as determined pursuant to subsection B of this section and seek drug addiction treatment.  The county may establish additional angel initiative programs elsewhere throughout the county.

B.  The county and the local public health authority shall determine based on need the police precinct in which the angel initiative program shall be placed.

C.  The county, in collaboration with the local law enforcement agencies, shall prescribe standards for the operation of the angel initiative program.  At a minimum, the standards shall provide that a person shall meet the following eligibility criteria to participate in the program:

1.  Be eighteen years of age or older.

2.  Attest that the person is willing and able to follow staff directions.

3.  Provide proof of a current, valid identification card.

4.  Agree to abide by all rules and refrain from engaging in illegal or inappropriate activity.

5.  Attest that the person is willing to participate in a drug detoxification program and obtain medical clearance, if detoxification is required.

6.  Be physically and mentally able to self-manage personal hygiene and self-care within a nonmedical, nonpsychiatric facility.

7.  Not be a fugitive from justice or have any prior or pending charges for crimes involving violence, arson, sexual offenses, children or the elderly.

D.  A person who, in good faith, seeks drug addiction treatment at an angel initiative program may not be charged with or prosecuted for the possession or use of a controlled substance or drug paraphernalia if the evidence for the violation was gained as a result of seeking drug addiction treatment at an angel initiative program.  END_STATUTE
