AN ACT

 

amending section 15‑901.02, Arizona Revised Statutes; relating to school finance.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 15-901.02, Arizona Revised Statutes, is amended to read:

START_STATUTE15-901.02.  Voluntary full-day kindergarten instruction

A school district or charter school may that offers kindergarten instruction shall offer full‑day kindergarten instruction to pupils who meet the enrollment requirements for kindergarten programs.  Parents of pupils who meet the enrollment requirements for voluntary kindergarten programs in a school district or charter school that offers full‑day kindergarten instruction may choose either half‑day kindergarten instruction or full‑day kindergarten a half day or a full day of instruction.  A school district or charter school is not required to have separate curricula for half‑day kindergarten and full‑day kindergarten.  If a charter school chooses to offer voluntary full‑day kindergarten instruction, Any necessary capital monies needed to implement voluntary full‑day kindergarten instruction shall be provided by the school district or charter school. Sec. 2.  Legislative intent

A.  The legislature recognizes that:

1.  Governor Doug Ducey has stated, "Any new funding for public schools must go directly into the classroom, identifying what works and focusing on English literacy for all students in this state."

2.  In passing this act, the legislature intends to provide access to, uniformity of and availability of educational services throughout this state.

3.  For kindergartners, one of the most effective ways to increase student performance is to increase instructional classroom time.

4.  Intensive English language literacy is the cornerstone of early childhood education.

B.  The legislature encourages school districts and charter schools to use a portion of the inflation funding that will be distributed as a result of the lawsuit designated as Cave Creek Unified School District v. Ducey, CV2010‑017113, to pay for the additional instruction required by this act.

Sec. 3.  Conditional enactment; notice; implementation

A.  This act does not become effective unless the lawsuit designated as Cave Creek Unified School District v. Ducey, CV2010‑017113, is resolved through either final adjudication by a court of competent jurisdiction or the execution of a binding settlement by all parties to the lawsuit.

B.  The attorney general shall notify in writing the director of the Arizona legislative council of the date on which the condition is met or if the condition is not met.

C.  School districts and charter schools shall implement this act in the next school year after the condition is met.
