AN ACT

 

appropriating monies to the department of education.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Appropriation; department of education; additional assistance for gifted education programs; administration; legislative intent; exemption

A.  The sum of $300,000 and three full‑time equivalent positions are appropriated from the state general fund in fiscal year 2021-2022 to the department of education to administer additional assistance for gifted education programs pursuant to section 15‑779.03, Arizona Revised Statutes, and provide technical assistance to schools.

B.  The legislature intends that the department should:

1.  Prioritize the distribution of monies pursuant to section 15‑779.03, Arizona Revised Statutes, to public schools in this state at which sixty percent or more of the students are eligible for free or reduced‑price lunches under the national school lunch and child nutrition acts (42 United States Code sections 1751 through 1793).

2.  To the extent practicable, distribute the monies to the public schools in increments of $10,000.

C.  The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
