AN ACT

 

APPROPRIATING monies to the Arizona criminal justice commission.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Appropriations; Arizona criminal justice commission; alternative prosecution and diversion programs; fiscal years 2020‑2021, 2021‑2022 and 2022‑2023; reports; definition

A.  The sum of $11,264,625 is appropriated from the state general fund in each of fiscal years 2020-2021, 2021-2022 and 2022-2023 to the Arizona criminal justice commission for alternative prosecution and diversion programs.  The commission may use $100,000 of the monies each fiscal year to administer this section, including the reporting requirements prescribed in subsection C of this section.  The remaining monies shall be allocated each fiscal year to each county attorney's office as follows:

5.  Graham                                   $   100,000

6.  Greenlee                                 $   100,000

7.  La Paz                                   $   100,000

9.  Mohave                                   $   451,403

10.  Navajo                                   $   238,997

11.  Pima                                     $ 2,192,281

12.  Pinal                                    $   933,957

13.  Santa Cruz                               $   111,055

14.  Yavapai                                  $   485,367

15.  Yuma                                     $   477,400

B.  The monies appropriated by this section may be used only to:

1.  Establish and operate alternative prosecution and diversion programs.

2.  Explore, develop, apply and evaluate evidence-based best practices for alternative prosecution and diversion programs.

3.  Supplement and not supplant monies otherwise available for alternative prosecution and diversion programs.

C.  On or before September 30 in 2021, 2022 and 2023, the Arizona criminal justice commission shall submit a report to the joint legislative budget committee on the use of the monies and the outcomes obtained by the alternative prosecution and diversion programs during the previous fiscal year.  On request by the commission, each county attorney shall provide information reasonably necessary to complete the reports.

D.  For the purposes of this section, "diversion programs" includes prearrest programs that address the social and behavioral causes of criminogenic conduct.
