HOUSE BILL 2404

 

 

AN ACT

 

amending section 17‑363, Arizona Revised Statutes; relating to taxidermists.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Heading change

The article heading of title 17, chapter 3, article 3, Arizona Revised Statutes, is changed from "trappers, guides and taxidermists" to "trappers, guides, taxidermists and fur dealers".

Sec. 2.  Section 17-363, Arizona Revised Statutes, is amended to read:

START_STATUTE17-363.  Practice of taxidermy; registration required; rules; register; revocation; suspension; civil penalty

A.  No A person shall not engage in the business of a taxidermist for hire until such that person has procured a license which may be granted to any person at the discretion of the commission registers with the department.  The department shall adopt rules to allow a person to register pursuant to this section.

B.  A taxidermist shall:

1.  Keep a register, and exhibit it upon request of authorized representatives of the game and fish department and the United States fish and wildlife service, of the names and addresses of persons who furnish raw and unmounted specimens, the taker's tag or license number,  and the date and number of each species of wildlife received, and shall by the tenth day of October, January, April and July, file a legible report in English with the department of such entries except names and addresses on forms provided therefor.

2.  Exhibit the register on request of an authorized representative of the department.

3.  Maintain the register for five years after the date the wildlife was received.

4.  File a copy of the register in English with the department on or before January 31 of each year.

C.  After a public hearing, the commission may revoke or suspend the registration of a person who violates this section and deny the person the right to register with the department as a taxidermist for hire under subsection A of this section for a period not to exceed one year.

D.  A person who violates this section is subject to a civil penalty of one hundred fifty dollars. END_STATUTE

Sec. 3.  Effective date

Section 17-363, Arizona Revised Statutes, as amended by this act, is effective from and after December 31, 2018.
