AN ACT

 

amending section 41-746, Arizona Revised Statutes; relating to the state personnel system.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 41-746, Arizona Revised Statutes, is amended to read:

START_STATUTE41-746.  Refusal of consideration for employment; wage history; verification of education and work history

A.  The director may refuse to consider for employment or remove from consideration for employment any applicant who:

1.  Has practiced any deception or fraud in the applicant's application.

2.  Has failed to reply within a reasonable time to communications concerning the applicant's availability for employment.

3.  Is found to be unsuited or not qualified for employment.

4.  Lacks any of the requirements established by the director for the position for which the applicant applies.

B.  A state agency head may not ask an applicant to provide the applicant's wage history.  An applicant may voluntarily provide the applicant's wage history to a state agency head, and, if so provided, the state agency head may require the applicant to confirm the applicant's wage history or allow the state agency head to confirm the applicant's wage history after the state agency head has offered the applicant the position.  For the purposes of this subsection, "state agency head" includes the state agency head's designee.

B.  C.  The director shall develop procedures and standard forms to be used by all state agencies to verify a candidate's an applicant's education and work history.  The procedures shall include a requirement that a state agency head shall make documented, good faith efforts to contact current and previous employers of a candidate an applicant to obtain information and recommendations that may be relevant to the candidate's applicant's fitness for employment.
