AN ACT
amending title 12, chapter 5, article 1, Arizona Revised Statutes, by adding section 12-512; relating to noneconomic damages; providing for conditional enactment.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 12, chapter 5, article 1, Arizona Revised Statutes, is amended by adding section 12-512, to read:
12-512. Civil actions; limitation on noneconomic damages; definition
A. If a final action is issued against a person, the amount of noneconomic damages shall be limited to a total amount of not more than __________________ dollars.
B. For the purposes of this section, "noneconomic damages" means damages awarded for the purpose of compensating a claimant for physical pain and suffering, mental or emotional pain or anguish, loss of consortium, disfigurement, physical impairment, loss of companionship and society, inconvenience, loss of enjoyment of life, injury to reputation and all other nonpecuniary losses other than punitive damages.
Sec. 2. Conditional enactment
This act does not become effective unless the Constitution of Arizona is amended by vote of the people at the next general election by repealing article II, section 31 and article XVIII, section 6, Constitution of Arizona.
