AN ACT

 

amending title 36, chapter 1, article 1, Arizona Revised Statutes, by adding section 36‑113; amending title 43, chapter 6, article 1, Arizona Revised Statutes, by adding section 43‑623; relating to individual income tax refunds.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 36-113, to read:

START_STATUTE36-113.  Alzheimer's research fund; use; exemption; definition

A.  The Alzheimer's research fund is established consisting of monies received pursuant to section 43‑623.

B.  Subject to legislative appropriation, the director shall spend monies in the fund as grants awarded to nonprofit and for‑profit organizations exclusively for the purpose of Alzheimer's research, including research into the cause, diagnosis, treatment and care for Alzheimer's disease and other dementia disorders.

C.  The director shall administer the fund.  On notice from the director, the state treasurer shall invest and divest monies in the fund as provided by section 35‑313, and monies earned from investment shall be credited to the fund.  Monies in the fund are exempt from the provisions of section 35‑190 relating to the lapsing of appropriations.

D.  For the purposes of this section, "Alzheimer's" means a progressive, degenerative disorder that attacks the nerve cells or neurons of an individual's brain and that results in loss of memory, thinking and language skills and behavioral changes. END_STATUTE

Sec. 2.  Title 43, chapter 6, article 1, Arizona Revised Statutes, is amended by adding section 43-623, to read:

START_STATUTE43-623.  Contribution to Alzheimer's research fund

A.  The department shall provide a space on the individual income tax return form in which a taxpayer may designate an amount of the taxpayer's refund as a voluntary contribution to the Alzheimer's research fund established by section 36‑113.

B.  After subtracting any setoff for debts pursuant to section 42‑1122, the department of revenue shall subtract the designated amount from the refund due the taxpayer and transfer it to the department of health services for deposit in the Alzheimer's research fund.  The department of revenue shall determine the initial administrative cost of this section and report the amount to the department of health services.  The department of health services shall transfer that amount to the state general fund.

C.  The taxpayer may also donate any amount to the Alzheimer's research fund, in lieu of or in addition to the designated portion of the tax refund, by an appropriate indication on the return and by including that amount with the return. END_STATUTE

Sec. 3.  Retroactivity

Section 43-623, Arizona Revised Statutes, applies retroactively to taxable years beginning from and after December 31, 2014.
