HOUSE BILL 2209

 

 

 

AN ACT

 

amending sections 28‑9201 and 28‑9202, Arizona Revised Statutes; relating to light rail transit system safety.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 28-9201, Arizona Revised Statutes, is amended to read:

START_STATUTE28-9201.  Minimum safety standards; violation

A.  As prescribed by 49 United States Code section 5330 and 49 Code of Federal Regulations part 659 (1995), the department shall establish, implement and enforce minimum safety standards for light rail transit systems and street car systems in a county with a population of more than one million five hundred thousand persons.

B.  If the department discovers a violation of the safety standards prescribed in subsection A, the department shall report the violation in writing to the federal transit administration. END_STATUTE

Sec. 2.  Section 28-9202, Arizona Revised Statutes, is amended to read:

START_STATUTE28-9202.  Public records; confidentiality

The department's information relating to the safety oversight of light rail transit systems and street car systems in a county with a population of more than one million five hundred thousand persons is a public record pursuant to title 39, chapter 1, except that, if the director, in consultation with the federal transit administration, determines the release of certain information would threaten the safety and security of the public, the director may keep the information confidential.
