AN ACT

 

ESTABLISHING the groundwater resource MANAGEMENT and land credit task force.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Groundwater resource management and land credit task force; membership; powers and duties; report; delayed repeal

A.  The groundwater resource management and land credit task force is established consisting of the following members:

1.  Two members of the house of representatives who are appointed by the speaker of the house of representatives and who are members of different political parties.  The speaker of the house of representatives shall designate one of these members to serve as cochairperson of the committee.

2.  Two members of the senate who are appointed by the president of the senate and who are members of different political parties.  The president of the senate shall designate one of these members to serve as cochairperson of the committee.

3.  One member who represents a county with a population of less than three hundred thousand persons and who is appointed by the speaker of the house of representatives.

4.  One member who represents agricultural property owners and who is appointed by the speaker of the house of representatives.

5.  One member who represents builders or developers of residential, commercial or industrial property and who is appointed by the president of the senate.

6.  The director of the department of water resources or the director's designee.

7.  The chief executive officer of the Arizona commerce authority or the chief executive officer's designee.

B.  The task force shall meet on the call of either of its cochairpersons.

C.  The task force shall establish a framework and criteria for a property development credit program to encourage appropriate donation, acquisition and use of conservation areas that will provide support for maintenance of groundwater and other ecological resources in exchange for development credits usable on private land suitable for development.  A property development credit program shall include at least consideration of the following:

1.  Creation of a standard conservation easement, including appropriate types of land use restrictions and utility allowances.

2.  Establishment of a standard credit value per acre for real property donated to cities, towns and counties for administration under conservation easements or similar use restrictions.

3.  Creation of a credit assignment formula for use by owners of real property who donate property for development credits, which shall include valuation of restrictions on the donated property.

4.  Establishment of criteria for free market purchase and sale of assigned development credits.

5.  Establishment of county and municipal credit redemption processes that allow increased density for land developed with these credits.

D.  The task force may request information, data and reports from any county or state agency or political subdivision of this state and shall hold hearings and take testimony from persons who may assist the task force in fulfilling its responsibilities.

E.  Members of the task force are not eligible to receive compensation but are eligible for reimbursement of expenses pursuant to title 38, chapter 4, article 2, Arizona Revised Statutes.

F.  On or before December 31, 2017, the task force shall submit a report regarding its findings and recommendations to the governor, the speaker of the house of representatives and the president of the senate and provide a copy of this report to the secretary of state.

G.  This section is repealed from and after September 30, 2018.
