AN ACT

 

Amending Title 11, chapter 7, article 3, Arizona Revised Statutes, by adding section 11-956; relating to the joint exercise of powers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 11, chapter 7, article 3, Arizona Revised Statutes, is amended by adding section 11-956, to read:

START_STATUTE11-956.  City, town or county agreements; approval and extension requirements; exceptions; definition

A.  A city, town or county shall enter into an agreement only after an affirmative vote of the majority of the members of the governing body of the city, town or county at a public hearing.

B.  The duration of an agreement to which a city, town or county is a party may not be more than eight years. To extend an agreement, the governing body of the city, town or county shall review the agreement and hold a public hearing to determine whether to extend the agreement.  An affirmative vote of the majority of the members of the governing body of the city, town or county is required to extend the agreement. If the governing body of the city, town or county does not extend the agreement, the agreement is terminated.

C.  the governing body of the city, town or county shall review all agreements that are in place on the effective date of this section and hold a public hearing to reaffirm the agreements.  An affirmative vote of the majority of the members of the governing body of the city, town or county is required to reaffirm the agreements. Any agreement reaffirmed pursuant to this subsection is valid for a maximum of eight years after the date on which the agreement is reaffirmed but may be extended as provided by subsection B of this section.

D.  The governing body of a city, town or county shall post all agreements on the city, town or county website.

E. This section does not apply to agreements that a city, town or county enters into for the purposes of section 11‑952.01 or 11‑955. 

F.  For the purposes of this section, "Agreement" means an intergovernmental agreement entered into pursuant to this article or any other agreement, including department charters.END_STATUTE
