HOUSE BILL 2126

 

 

 

AN ACT

 

Establishing the naturopathic medical pilot program.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Naturopathic medical pilot program; reports; delayed repeal; definition

A.  Subject to the availability of private funding and grants, beginning September 1, 2010 and ending September 1, 2012, the naturopathic medical treatment pilot program is established pursuant to this section.

B.  The Arizona health care cost containment system administration, in consultation with a naturopathic medical college that is located in this state and that is accredited by the council on naturopathic medical education, may allow one contractor or subcontractor to refer members who are enrolled pursuant to title 36, chapter 29, article 1, Arizona Revised Statutes, and who are suffering from a chronic condition to a naturopathic physician who is licensed pursuant to title 32, chapter 14, Arizona Revised Statutes.  The naturopathic physician shall act as a specialist acting under the supervision of the referring physician who is licensed pursuant to title 32, chapter 13 or 17, Arizona Revised Statutes.  Services provided pursuant to this subsection must be:

1.  Within the scope of practice of the naturopathic physician.

2.  Provided only after consultation with the supervising physician.

3.  Authorized by the contractor or subcontractor.

C.  The cost of treatment provided pursuant to the pilot program must be paid from private monies and grants received for the pilot program.  The administration may not use federal matching monies to fund services provided pursuant to the pilot program.

D.  On or before December 1 of each year, the administration shall submit to the governor, the speaker of the house of representatives and the president of the senate a written report of the cost of treatments provided pursuant to the pilot program.  The administration shall provide a copy of this report to the secretary of state.

E.  On or before December 1, 2012, the administration shall examine the results of the pilot program and submit a written report of its findings to the governor, the speaker of the house of representatives and the president of the senate.  The report shall include a recommendation on whether the administration believes the pilot program should be continued or expanded.  The administration shall provide a copy of this report to the secretary of state.

F.  This section is repealed from and after September 30, 2013.

G.  For the purposes of this section, "chronic condition" means a chronic condition prescribed by the administration.
