AN ACT

 

amending Title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-117; relating to PHYSICAL ACTIVITY IN SCHOOLs.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-117, to read:

START_STATUTE15-117.  Daily physical activity; policy; public meeting; exemption

A.  On or before January 1, 2017, each school district governing board and each charter school governing body shall conduct a public meeting to consider adopting a policy to provide daily physical activity to pupils in kindergarten programs and grades one through five.  The school district or charter school shall notify each parent of a child who is enrolled in the school district or charter school, as applicable, of any public meeting called pursuant to this subsection and shall allow any parent to comment on the proposed policy at that public meeting.  The school district governing board or charter school governing body shall discuss and vote on the adoption of the proposed daily physical activity policy after receiving parent comments on the proposed policy.

B.  If a daily physical activity policy is adopted pursuant to subsection A of this section:

1.  The daily physical activity requirements shall consist of structured or unstructured physical activity inside or outside of the classroom.

2.  Physical education classes may be used to satisfy the requirements of this section.

3.  Unstructured recess time that occurs immediately before or after lunch periods does not satisfy the requirements of this section.

C.  School districts and charter schools that do not provide instruction to pupils in kindergarten programs or grades one through five are not required to conduct a public meeting to consider adopting a daily physical activity policy pursuant to subsection A of this section. END_STATUTE
