AN ACT

 

amending title 41, chapter 7, article 1, Arizona Revised Statutes, by adding section 41-1108; relating to the legislature.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 7, article 1, Arizona Revised Statutes, is amended by adding section 41-1108, to read:

START_STATUTE41-1108.  Legislators required to vote unless excused; loss of salary; definition

A.  Each member of the legislature shall vote on all roll call votes relating to third reading and final passage of a bill, memorial or resolution unless the member has a personal financial interest in the question as prescribed by the rules of the house of representatives or senate or unless the member is excused from voting pursuant to the rules of the house of representatives or senate or by the speaker of the house of representatives or the president of the senate.

B.  Notwithstanding any other law, if a member of the legislature fails to vote on any bill, memorial or resolution as provided for in subsection a of this section and is not excused from voting pursuant to subsection a of this section, the member shall forfeit the legislative subsistence provided by section 41-1104 in an amount that is equal to the legislative salary for that day.  If the amount forfeited pursuant to this subsection is greater than the subsistence payable for the pay period, the amount owed shall be deducted from any subsistence that is payable in a subsequent pay period.

C.  Beginning January 10, 2011 the legislature's website shall post on a daily basis the roll call votes relating to third reading and final passage of a bill, resolution or memorial on that day, the names of those legislators who failed to vote on the bill, resolution or memorial and if the member was excused from such a vote.

D.  For the purposes of this section, "legislative salary for that day" means the greater of:

1.  One hundred seventy-five dollars.

2.  The average annual legislative salary for the five preceding years divided by the average number of days in regular session during the five preceding years. END_STATUTE
