A JOINT RESOLUTION
  proposing a constitutional amendment prohibiting the authorization
  or funding of an elementary or secondary education voucher program.
         BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Article VII, Texas Constitution, is amended by
  adding Section 7 to read as follows:
         Sec. 7.  (a) In this section, "private school" means a
  nongovernmental educational establishment that exists for the
  general education of elementary or secondary students.
         (b)  The legislature may not appropriate money for or
  authorize a voucher program under which state or local public
  revenue is used to pay all or any part of the costs of a student's
  attendance at a private school.
         (c)  This section does not prohibit the use of state or local
  public revenue to pay all or any part of the costs of attendance at a
  private school by a student with a disability for the purpose of
  receiving special education services that would otherwise be
  unavailable to the student.
         SECTION 2.  This proposed constitutional amendment shall be
  submitted to the voters at an election to be held November 5, 2013.
  The ballot shall be printed to permit voting for or against the
  proposition: "The constitutional amendment prohibiting the
  authorization or funding of a voucher program for elementary or
  secondary education."
