A BILL TO BE ENTITLED
 
AN ACT
  relating to the failure to attend school for part of a day.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 25.094, Education Code, is amended by
  adding Subsection (a-1) to read as follows:
         (a-1)  For purposes of Subsection (a), an individual fails to
  attend school on a part of a day only if the individual misses:
               (1)  more than 15 percent of an instructional day; or
               (2)  more than 15 percent of a class period.
         SECTION 2.  Section 51.03, Family Code, is amended by adding
  Subsection (h) to read as follows:
         (h)  For purposes of Subsection (b)(2), a child is absent for
  a part of a day only if the child misses:
               (1)  more than 15 percent of an instructional day; or
               (2)  more than 15 percent of a class period.
         SECTION 3.  The change in law made by this Act applies only
  to an offense committed or conduct violating a penal law that occurs
  on or after the effective date of this Act. An offense committed or
  conduct that occurs before the effective date of this Act is
  governed by the law in effect on the date the offense was committed
  or conduct occurred, and the former law is continued in effect for
  that purpose. For purposes of this section, an offense was
  committed or conduct violating a penal law occurred before the
  effective date of this Act if any element of the offense or
  violation occurred before that date.
         SECTION 4.  This Act takes effect September 1, 2015.
