A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to creating the criminal offense of tampering with a |
|
|
correctional facility tablet device. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 38, Penal Code, is amended by adding |
|
|
Section 38.115 to read as follows: |
|
|
Sec. 38.115. TAMPERING WITH CORRECTIONAL FACILITY TABLET |
|
|
DEVICE. (a) In this section, "correctional facility" means: |
|
|
(1) any place described by Section 1.07(a)(14)(A), |
|
|
(B), or (C); or |
|
|
(2) a secure correctional facility or secure detention |
|
|
facility, as defined by Section 51.02, Family Code. |
|
|
(b) A person commits an offense if the person, while |
|
|
confined in a correctional facility, alters, modifies, or breaches |
|
|
the security, programming, or operating system of a tablet device |
|
|
provided to the person by the operator of the correctional |
|
|
facility. |
|
|
(c) An offense under this section is a felony of the third |
|
|
degree. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
