A BILL TO BE ENTITLED
 
AN ACT
  relating to restrictions on the use of commercial social networking
  sites by sex offenders; imposing a criminal penalty.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 62, Code of Criminal Procedure, is
  amended by adding Article 62.0552 to read as follows:
         Art. 62.0552.  USE OF COMMERCIAL SOCIAL NETWORKING SITES BY
  CERTAIN OFFENDERS. (a) In this article, "commercial social
  networking site" has the meaning assigned by Article 62.0061(f).
         (b)  A person required to register under this chapter who
  uses a commercial social networking site and is not otherwise
  prohibited from accessing the site under Section 13G, Article
  42.12, shall include the following information in the person's
  profile for the site and shall ensure the information is viewable by
  all visitors of the site:
               (1)  an indication that the person is a sex offender;
               (2)  the type of offense for which the person is subject
  to registration under this chapter and the city and county in which
  the person was convicted of or placed on deferred adjudication for
  that offense;
               (3)  the person's full name, date of birth, sex, race,
  height, weight, eye color, and hair color; and
               (4)  the address at which the person resides or intends
  to reside or, if the person does not reside or intend to reside at a
  physical address, a detailed description of each geographical
  location at which the person resides or intends to reside.
         SECTION 2.  The change in law made by this Act in amending
  Chapter 62, Code of Criminal Procedure, applies to any person who,
  on or after the effective date of this Act, is subject to
  registration under that chapter, regardless of whether the offense
  for which the person is subject to registration was committed
  before, on, or after the effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2013.
