SUMMARY

Prohibits Department of Transportation from administering
examination for driver license in language other than English.
Prohibits person from using interpreter to take examination for
driver licence. Provides exception for sign language interpreter
for person with disability.
A BILL FOR AN ACT
Relating to examination for driver license.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section:
(a) 'Interpreter' means a person who translates conversations
or other communications for a non-English-speaking person or
translates the statements of a non-English-speaking person.
(b) 'Non-English-speaking person' means a person who, by reason
of place of birth or culture, speaks a language other than
English and does not speak English with adequate ability to
understand the examinations administered for a driver license or
driver permit.
(c) 'Person with a disability' means a person who cannot
readily understand or communicate the spoken English language, or
cannot understand the examinations administered for a driver
license or driver permit, because of deafness or because of a
physical hearing impairment or communicate in the examinations
because of a physical speaking impairment.
(d) 'Sign language interpreter' means a person who translates
conversations or other communications for a person with a
disability or translates the statements of a person with a
disability.
(2) The Department of Transportation may not administer an
examination under ORS 807.070 in a language other than English.
(3) Except as provided in subsection (4) of this section, a
person may not use an interpreter to take an examination
administered under ORS 807.070.
(4) A person with a disability may use a sign language
interpreter to take an examination administered under ORS
807.070. + }
SECTION 2. { + Section 1 of this 2011 Act applies to
examinations administered under ORS 807.070 on or after the
effective date of this 2011 Act. + }
