To amend sections 101.27, 141.011, 141.04, 325.03, 1
325.04, 325.06, 325.08, 325.09, 325.10, 325.11, 2
325.14, 325.15, 325.18, 505.24, 507.09, and 3
3501.12 and to enact sections 195.01, 195.02, 4
195.03, 195.04, 195.05, and 195.06 of the Revised 5
Code and to amend Section 307.10 of Am. Sub. H.B. 6
59 of the 130th General Assembly to reinstate the 7
cost of living adjustment for members of the 8
General Assembly and statewide elected executive 9
officers; to increase the compensation of justices 10
and judges of the courts, county elected 11
officials, township trustees and fiscal officers, 12
and board of elections members and to reinstate 13
the annual cost of living adjustment to their 14
compensation; to reduce the number of population 15
classifications used to determine the compensation 16
of county elected officials; to create the Ohio 17
Public Officials Compensation Advisory Commission; 18
and to make appropriations.19


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 101.27, 141.011, 141.04, 325.03, 20
325.04, 325.06, 325.08, 325.09, 325.10, 325.11, 325.14, 325.15, 21
325.18, 505.24, 507.09, and 3501.12 be amended and sections 22
195.01, 195.02, 195.03, 195.04, 195.05, and 195.06 of the Revised 23
Code be enacted to read as follows:24

       Sec. 101.27.  (A)(1) Every member of the senate, except the 25
members elected president, president pro tempore, assistant 26
president pro temporemajority floor leader, majority whip, 27
minority leader, assistant minority leader, minority whip, and 28
assistant minority whip, shall receive as compensation a salary of 29
fifty-onesixty thousand sixfive hundred seventy-four30
eighty-three dollars and seventy cents a year during the senator's 31
term of office. Every member of the house of representatives, 32
except the members elected speaker, speaker pro tempore, majority 33
floor leader, assistant majority floor leader, majority whip, 34
assistant majority whip, minority leader, assistant minority 35
leader, minority whip, and assistant minority whip, shall receive 36
as compensation a salary of fifty-onesixty thousand sixfive37
hundred seventy-foureighty-three dollars and seventy cents a 38
year during the representative's term of office. Such salaries 39
shall be paid in equal monthly installments during such term. All 40
monthly payments shall be made on or before the fifth day of each 41
month. Upon the death of any member of the general assembly during 42
the member's term of office, any unpaid salary due such member for 43
the remainder of the member's term shall be paid to the member's 44
surviving spouse, children, mother, or father, in the order in 45
which the relationship is set forth in this section in monthly 46
installments.47

       (2) Each member shall receive a travel reimbursement per mile 48
each way, at the same mileage rate allowed for the reimbursement 49
of travel expenses of state agents as provided by rule of the 50
director of budget and management pursuant to division (B) of 51
section 126.31 of the Revised Code, for mileage not more than once 52
a week during the session for travel incurred by a member from and 53
to the member's place of residence, by the most direct highway 54
route of public travel to and from the seat of government, to be 55
paid quarterly on the last day of March, June, September, and 56
December of each year.57

       (3) The member of the senate elected president and the member 58
of the house of representatives elected speaker shall each receive 59
as compensation a salary of eightyninety-four thousand fivefour60
hundred forty-ninethirty-seven dollars and thirty-six cents a 61
year during the president's or speaker's term of office.62

       The member of the senate elected president pro tempore, the 63
member of the senate elected minority leader, the member of the 64
house of representatives elected speaker pro tempore, and the 65
member of the house of representatives elected minority leader 66
shall each receive as compensation a salary of seventy-three67
eighty-six thousand fourone hundred ninety-threesixty-four68
dollars and seventy-six cents a year during the member's term of 69
office. The member of the house of representatives elected 70
majority floor leader and the member of the senate elected71
assistant president pro temporemajority floor leader shall each 72
receive as compensation a salary of sixty-nineeighty-one thousand 73
twoone hundred twenty-sevensixty-three dollars and twenty-one 74
cents a year during the member's term of office. The member of the 75
senate elected assistant minority leader and the member of the 76
house of representatives elected assistant minority leader shall 77
each receive as compensation a salary of sixty-sevenseventy-eight78
thousand ninety-ninesix hundred sixty-eight dollars and thirty 79
cents a year during the member's term of office. The member of the 80
senate elected majority whip and the member of the house of 81
representatives elected assistant majority floor leader shall each 82
receive a salary of sixty-fourseventy-six thousand nineone83
hundred sixty-sevensixty-eight dollars and sixty-nine cents a 84
year during the member's term of office. The member of the senate 85
elected minority whip, the member of the house of representatives 86
elected majority whip, and the member of the house of 87
representatives elected minority whip shall each receive as 88
compensation a salary of sixtyseventy-one thousand sevenone89
hundred sixseventy-three dollars a year during the member's term 90
of office. The member of the house of representatives elected 91
assistant majority whip shall receive as compensation a salary of 92
fifty-sixsixty-six thousand fourone hundred forty-three93
seventy-four dollars and ninety-seven cents a year during the 94
member's term of office. The member of the house of 95
representatives elected assistant minority whip and the member of 96
the senate elected assistant minority whip shall each receive a 97
salary of fifty-foursixty-three thousand sixtythree hundred 98
eighty-one dollars and nine cents a year during the member's term 99
of office.100

       (4) The chairperson of the finance committee of each house 101
shall receive an additional sum of ten thousand dollars annually. 102
The chairperson of each standing committee of each house other 103
than the finance committee shall receive an additional sum of six 104
thousand five hundred dollars annually. The chairperson of each 105
standing subcommittee of a finance committee shall receive an 106
additional sum of six thousand five hundred dollars annually. The 107
vice-chairperson of the finance committee of each house shall 108
receive an additional sum of five thousand five hundred dollars 109
annually. The ranking minority member of the finance committee of 110
each house shall receive an additional sum of six thousand five 111
hundred dollars annually. The ranking minority member of each 112
standing subcommittee of a finance committee shall receive an 113
additional sum of five thousand dollars annually. The chairperson 114
of each standing subcommittee of each house other than a standing 115
subcommittee of the finance committee shall receive an additional 116
sum of five thousand dollars annually. The vice-chairperson and 117
ranking minority member of each standing committee of each house 118
other than the finance committee shall each receive an additional 119
sum of five thousand dollars annually. Except for the ranking 120
minority member of each standing subcommittee of a finance 121
committee, the ranking minority member of each standing 122
subcommittee of each house shall receive an additional sum of two 123
thousand five hundred dollars annually.124

       No member may receive more than one additional sum for 125
serving as chairperson, vice-chairperson, or ranking minority 126
member of a standing committee or standing subcommittee, 127
regardless of the number of standing committees or standing 128
subcommittees on which the member serves as chairperson, 129
vice-chairperson, or ranking minority member.130

       (5) If a member is absent without leave, or is not excused on 131
the member's return, there shall be deducted from the member's 132
compensation twenty dollars for each day's absence.133

       (B) Each calendar year from 2002 through 20082017 through 134
2023, the salary amounts under divisions (A)(1) and (3) of this 135
section in the immediately preceding calendar year shall be 136
increased by the lesser of the following:137

       (1) Three per cent;138

       (2) The percentage increase, if any, in the consumer price 139
index over the twelve-month period that ends on the thirtieth day 140
of September of the immediately preceding year, rounded to the 141
nearest one-tenth of one per cent.142

       (C) As used in this section:143

       (1) "Consumer price index" means the consumer price index 144
prepared by the United States bureau of labor statistics (U.S. 145
city average for urban wage earners and clerical workers: all 146
items, 1982-1984=100), or, if that index is no longer published, a 147
generally available comparable index.148

       (2) "Finance committee" means the finance committee of the 149
senate and the finance-and appropriations committee of the house 150
of representatives.151

       Sec. 141.011. Beginning in calendar year 2001, theThe152
annual salaries of the elective officers of the state shall be as 153
follows rather than as prescribed by divisions (A) to (F) of 154
section 141.01 of the Revised Code:155

       (A)(1) In calendar year 2001 the annual salary of the 156
governor shall be one hundred twenty-six thousand four hundred 157
ninety-seven dollars.158

       (2) In calendar years 2002 through 2006, the annual salary of 159
the governor shall be one hundred thirty thousand two hundred 160
ninety-two dollars.161

       (3)(2) In calendar year 2007, the annual salary of the 162
governor shall be the annual salary in 2006 increased by each of 163
the following percentages in succession:164

       (a) The lesser of three per cent or the percentage increase, 165
if any, in the consumer price index from October 1, 2001, to 166
September 30, 2002, rounded to the nearest one-tenth of one per 167
cent;168

       (b) The lesser of three per cent or the percentage increase, 169
if any, in the consumer price index from October 1, 2002, to 170
September 30, 2003, rounded to the nearest one-tenth of one per 171
cent;172

       (c) The lesser of three per cent or the percentage increase, 173
if any, in the consumer price index from October 1, 2003, to 174
September 30, 2004, rounded to the nearest one-tenth of one per 175
cent;176

       (d) The lesser of three per cent or the percentage increase, 177
if any, in the consumer price index from October 1, 2004, to 178
September 30, 2005, rounded to the nearest one-tenth of one per 179
cent;180

       (e) The lesser of three per cent or the percentage increase, 181
if any, in the consumer price index from October 1, 2005, to 182
September 30, 2006, rounded to the nearest one-tenth of one per 183
cent.184

       (4) In(3) Each calendar year from 2008 and thereafter185
through 2016, the annual salary of the governor shall be the 186
annual salary in 2007 increased by the lesser of the following:187

       (a) Three per cent;188

       (b) The percentage increase, if any, in the consumer price 189
index from October 1, 2006, to September 30, 2007, rounded to the 190
nearest one-tenth of one per cent.191

       (4) Each calendar year from 2017 through 2023, the annual 192
salary of the governor shall be the annual salary in the 193
immediately preceding calendar year, increased by the lesser of 194
the following:195

       (a) Three per cent;196

       (b) The percentage increase, if any, in the consumer price 197
index over the twelve-month period that ends on the thirtieth day 198
of September of the immediately preceding year, rounded to the 199
nearest one-tenth of one per cent.200

       (B)(1) In calendar year 2001 the annual salary of the 201
lieutenant governor shall be sixty-six thousand three hundred six 202
dollars.203

       (2) In calendar years 2002 through 2006, the annual salary of 204
the lieutenant governor shall be sixty-eight thousand two hundred 205
ninety-five dollars.206

       (3)(2) In calendar year 2007, the annual salary of the 207
lieutenant governor shall be the annual salary in 2006 increased 208
by each of the following percentages in succession:209

       (a) The lesser of three per cent or the percentage increase, 210
if any, in the consumer price index from October 1, 2001, to 211
September 30, 2002, rounded to the nearest one-tenth of one per 212
cent;213

       (b) The lesser of three per cent or the percentage increase, 214
if any, in the consumer price index from October 1, 2002, to 215
September 30, 2003, rounded to the nearest one-tenth of one per 216
cent;217

       (c) The lesser of three per cent or the percentage increase, 218
if any, in the consumer price index from October 1, 2003, to 219
September 30, 2004, rounded to the nearest one-tenth of one per 220
cent;221

       (d) The lesser of three per cent or the percentage increase, 222
if any, in the consumer price index from October 1, 2004, to 223
September 30, 2005, rounded to the nearest one-tenth of one per 224
cent;225

       (e) The lesser of three per cent or the percentage increase, 226
if any, in the consumer price index from October 1, 2005, to 227
September 30, 2006, rounded to the nearest one-tenth of one per 228
cent.229

       (4) In(3) Each calendar year from 2008 and thereafter230
through 2016, the annual salary of the lieutenant governor shall 231
be the annual salary in 2007 increased by the lesser of the 232
following:233

       (a) Three per cent;234

       (b) The percentage increase, if any, in the consumer price 235
index from October 1, 2006 to September 30, 2007, rounded to the 236
nearest one-tenth of one per cent.237

       (4) Each calendar year from 2017 through 2023, the annual 238
salary of the lieutenant governor shall be the annual salary in 239
the immediately preceding calendar year, increased by the lesser 240
of the following:241

       (a) Three per cent;242

       (b) The percentage increase, if any, in the consumer price 243
index over the twelve-month period that ends on the thirtieth day 244
of September of the immediately preceding year, rounded to the 245
nearest one-tenth of one per cent.246

       If the governor appoints the lieutenant governor as an 247
administrative department head, the lieutenant governor may accept 248
the salary for that office while serving as its head in lieu of 249
the salary for the office of lieutenant governor.250

       (C)(1) In calendar year 2001 the annual salary of the 251
secretary of state, auditor of state, treasurer of state, and 252
attorney general shall be ninety-three thousand four hundred 253
forty-seven dollars.254

       (2) In calendar year 2002 theThe annual salary of the 255
secretary of state, auditor of state, treasurer of state, and 256
attorney general shall be ninety-sixone hundred nine thousand two257
nine hundred fiftyeighty-five dollars and ninety-two cents.258

       (3) In each(2) Each calendar year from 2003 through 2008259
2017 through 2023, the annual salary of the secretary of state, 260
auditor of state, treasurer of state, and attorney general shall 261
be the annual salary in the immediately preceding calendar year,262
increased by the lesser of the following:263

       (a) Three per cent;264

       (b) The percentage increase, if any, in the consumer price 265
index over the twelve-month period that ends on the thirtieth day 266
of September of the immediately preceding year, rounded to the 267
nearest one-tenth of one per cent.268

       (D) Upon the death of an elected executive officer of the 269
state listed in divisions (A) to (F) of section 141.01 of the 270
Revised Code during that person's term of office, an amount shall 271
be paid in accordance with section 2113.04 of the Revised Code, or 272
to that person's estate. The amount shall equal the amount of the 273
salary that the officer would have received during the remainder 274
of the officer's unexpired term or an amount equal to the salary 275
of that person's office for two years, whichever is less.276

       (E) As used in this section, "consumer price index" has the 277
same meaning as in section 101.27 of the Revised Code.278

       Sec. 141.04.  (A) The annual salaries of the chief justice of 279
the supreme court and of the justices and judges named in this 280
section payable from the state treasury are as follows, rounded to 281
the nearest fifty dollars:282

       (1) For the chief justice of the supreme court, the following 283
amounts effective in the following years:284

       (a) Beginning January 1, 20002014, one hundred twenty-four285
fifty thousand nineeight hundred fifty dollars;286

       (b) Beginning January 1, 2001, one hundred twenty-eight 287
thousand six hundred fifty dollarsof 2015, 2016, 2017, and 2018, 288
the amount of the annual salary in the immediately preceding 289
calendar year, increased by five per cent;290

       (c) After 2001Each calendar year from 2019 through 2023, the 291
amount determined under division (E)(1) of this section.292

       (2) For the justices of the supreme court, the following 293
amounts effective in the following years:294

       (a) Beginning January 1, 20002014, one hundred seventeen295
forty-one thousand twosix hundred fifty dollars;296

       (b) Beginning January 1, 2001, one hundred twenty thousand 297
seven hundred fifty dollarsof 2015, 2016, 2017, and 2018, the 298
amount of the annual salary in the immediately preceding calendar 299
year, increased by five per cent;300

       (c) After 2001Each calendar year from 2019 through 2023, the 301
amount determined under division (E)(1) of this section.302

       (3) For the judges of the courts of appeals, the following 303
amounts effective in the following years:304

       (a) Beginning January 1, 20002014, one hundred nine305
thirty-two thousand two hundred fifty dollars;306

       (b) Beginning January 1, 2001, one hundred twelve thousand 307
five hundred fifty dollarsof 2015, 2016, 2017, and 2018, the 308
amount of the annual salary in the immediately preceding calendar 309
year, increased by five per cent;310

       (c) After 2001Each calendar year from 2019 through 2023, the 311
amount determined under division (E)(1) of this section.312

       (4) For the judges of the courts of common pleas, the 313
following amounts effective in the following years:314

       (a) Beginning January 1, 20002014, one hundred twenty-one315
thousand fivethree hundred fifty dollars, reduced by an amount 316
equal to the annual compensation paid to that judge from the 317
county treasury pursuant to section 141.05 of the Revised Code;318

       (b) Beginning January 1, 2001, one hundred three thousand 319
five hundred dollarsof 2015, 2016, 2017, and 2018, the amount of 320
the annual salary in the immediately preceding calendar year, 321
increased by five per cent, reduced by an amount equal to the 322
annual compensation paid to that judge from the county treasury 323
pursuant to section 141.05 of the Revised Code;324

       (c) After 2001Each calendar year from 2019 through 2023, the 325
aggregate annual salary amount determined under division (E)(2) of 326
this section, reduced by an amount equal to the annual 327
compensation paid to that judge from the county treasury pursuant 328
to section 141.05 of the Revised Code.329

       (5) For the full-time judges of a municipal court or the 330
part-time judges of a municipal court of a territory having a 331
population of more than fifty thousand, the following amounts 332
effective in the following years, which amounts shall be in 333
addition to all amounts received pursuant to divisions (B)(1)(a) 334
and (2) of section 1901.11 of the Revised Code from municipal 335
corporations and counties:336

       (a) Beginning January 1, 20002014, thirty-twoone hundred 337
fourteen thousand sixone hundred fifty dollars, reduced by an 338
amount equal to the annual compensation paid to that judge 339
pursuant to division (B)(1)(a) of section 1901.11 of the Revised 340
Code from municipal corporations and counties;341

       (b) Beginning January 1, 2001, thirty-five thousand five 342
hundred dollars;of 2015, 2016, 2017, and 2018, the aggregate 343
amount of the annual salary paid in the immediately preceding 344
calendar year pursuant to division (A)(5) of this section and 345
division (B)(1)(a) of section 1901.11 of the Revised Code, 346
increased by five per cent.347

       (c) After 2001Each calendar year from 2019 through 2023, the 348
amount determined under division (E)(3) of this section, reduced 349
by an amount equal to the annual compensation paid to that judge 350
pursuant to division (B)(1)(a) of section 1901.11 of the Revised 351
Code.352

       (6) For judges of a municipal court designated as part-time 353
judges by section 1901.08 of the Revised Code, other than 354
part-time judges to whom division (A)(5) of this section applies, 355
and for judges of a county court, the following amounts effective 356
in the following years, which amounts shall be in addition to any 357
amounts received pursuant to division (A) of section 1901.11 of 358
the Revised Code from municipal corporations and counties or 359
pursuant to division (A) of section 1907.16 of the Revised Code 360
from counties:361

       (a) Beginning January 1, 20002014, eighteensixty-five362
thousand eightsix hundred fifty dollars, reduced by an amount 363
equal to the annual compensation paid to that judge pursuant to 364
division (A) of section 1901.11 of the Revised Code from municipal 365
corporations and counties or pursuant to division (A) of section 366
1907.16 of the Revised Code from counties;367

       (b) Beginning January 1, 2001, twenty thousand four hundred 368
fifty dollars;of 2015, 2016, 2017, and 2018, the aggregate amount 369
of the annual salary paid in the immediately preceding calendar 370
year pursuant to division (A)(6) of this section and division (A) 371
of section 1901.11 of the Revised Code or division (A) of section 372
1907.16 of the Revised Code, increased by five per cent.373

       (c) After 2001Each calendar year from 2019 through 2023, the 374
amount determined under division (E)(4) of this section, reduced 375
by an amount equal to the annual compensation paid to that judge 376
pursuant to division (A) of section 1901.11 of the Revised Code or 377
pursuant to division (A) of section 1907.16 of the Revised Code.378

       (B) Except as provided in sections 1901.122 and 1901.123 of 379
the Revised Code, except as otherwise provided in this division, 380
and except for the compensation to which the judges described in 381
division (A)(5) of this section are entitled pursuant to divisions 382
(B)(1)(a) and (2) of section 1901.11 of the Revised Code, the 383
annual salary of the chief justice of the supreme court and of 384
each justice or judge listed in division (A) of this section shall 385
be paid in equal monthly installments from the state treasury. If 386
the chief justice of the supreme court or any justice or judge 387
listed in division (A)(2), (3), or (4) of this section delivers a 388
written request to be paid biweekly to the administrative director 389
of the supreme court prior to the first day of January of any 390
year, the annual salary of the chief justice or the justice or 391
judge that is listed in division (A)(2), (3), or (4) of this 392
section shall be paid, during the year immediately following the 393
year in which the request is delivered to the administrative 394
director of the supreme court, biweekly from the state treasury.395

       (C) Upon the death of the chief justice or a justice of the 396
supreme court during that person's term of office, an amount shall 397
be paid in accordance with section 2113.04 of the Revised Code, or 398
to that person's estate. The amount shall equal the amount of the 399
salary that the chief justice or justice would have received 400
during the remainder of the unexpired term or an amount equal to 401
the salary of office for two years, whichever is less.402

       (D) Neither the chief justice of the supreme court nor any 403
justice or judge of the supreme court, the court of appeals, the 404
court of common pleas, or the probate court shall hold any other 405
office of trust or profit under the authority of this state or the 406
United States.407

       (E)(1) Each calendar year from 2002 through 20082019 through 408
2023, the annual salaries of the chief justice of the supreme 409
court and of the justices and judges named in divisions (A)(2) and 410
(3) of this section shall be increased by an amount equal to the 411
adjustment percentage for that year multiplied by the compensation 412
paid the preceding year pursuant to division (A)(1), (2), or (3) 413
of this section.414

       (2) Each calendar year from 2002 through 20082019 through 415
2023, the aggregate annual salary payable under division (A)(4) of 416
this section to the judges named in that division shall be 417
increased by an amount equal to the adjustment percentage for that 418
year multiplied by the aggregate compensation paid the preceding 419
year pursuant to division (A)(4) of this section and section 420
141.05 of the Revised Code.421

       (3) Each calendar year from 2002 through 20082019 through 422
2023, the salary payable from the state treasury under division 423
(A)(5) of this section to the judges named in that division shall 424
be increased by an amount equal to the adjustment percentage for 425
that year multiplied by the aggregate compensation paid the 426
preceding year pursuant to division (A)(5) of this section and 427
division (B)(1)(a) of section 1901.11 of the Revised Code.428

       (4) Each calendar year from 2002 through 20082019 through 429
2023, the salary payable from the state treasury under division 430
(A)(6) of this section to the judges named in that division shall 431
be increased by an amount equal to the adjustment percentage for 432
that year multiplied by the aggregate compensation paid the 433
preceding year pursuant to division (A)(6) of this section and 434
division (A) of section 1901.11 of the Revised Code from municipal 435
corporations and counties or division (A) of section 1907.16 of 436
the Revised Code from counties.437

       (F) In addition to the salaries payable pursuant to this 438
section, the chief justice of the supreme court and the justices 439
of the supreme court shall be entitled to a vehicle allowance of 440
five hundred dollars per month, payable from the state treasury. 441
The allowance shall be increased on the first day of January of 442
each odd-numbered year by an amount equal to the percentage 443
increase, if any, in the consumer price index for the immediately 444
preceding twenty-four month period for which information is 445
available.446

       (G) On or before the first day of December of each year, the 447
Ohio supreme court, through its chief administrator, shall notify 448
the administrative judge of the Montgomery county municipal court, 449
the board of county commissioners of Montgomery county, and the 450
treasurer of the state of the yearly salary cost of five part-time 451
county court judges as of that date. If the total yearly salary 452
costs of all of the judges of the Montgomery county municipal 453
court as of the first day of December of that same year exceeds 454
that amount, the administrative judge of the Montgomery county 455
municipal court shall cause payment of the excess between those 456
two amounts less any reduced amount paid for the health care costs 457
of the Montgomery county municipal court judges in comparison to 458
the health care costs of five part-time county court judges from 459
the general special projects fund or the fund for a specific 460
special project created pursuant to section 1901.26 of the Revised 461
Code to the treasurer of Montgomery county and to the treasurer of 462
the state in amounts proportional to the percentage of the 463
salaries of the municipal court judges paid by the county and by 464
the state.465

       (H) As used in this section:466

       (1) The "adjustment percentage" for a year is the lesser of 467
the following:468

       (a) Three per cent;469

       (b) The percentage increase, if any, in the consumer price 470
index over the twelve-month period that ends on the thirtieth day 471
of September of the immediately preceding year, rounded to the 472
nearest one-tenth of one per cent.473

       (2) "Consumer price index" has the same meaning as in section 474
101.27 of the Revised Code.475

       (3) "Salary" does not include any portion of the cost, 476
premium, or charge for health, medical, hospital, dental, or 477
surgical benefits, or any combination of those benefits, covering 478
the chief justice of the supreme court or a justice or judge named 479
in this section and paid on the chief justice's or the justice's 480
or judge's behalf by a governmental entity.481

       Sec. 195.01. (A) There is hereby created the Ohio public 482
officials compensation advisory commission to recommend the 483
salaries of all state and local elected officials. 484

       (B) The commission shall consist of the following members:485

       (1) Two members appointed by the governor, one from each 486
major political party;487

       (2) Two members appointed by the president of the senate;488

       (3) One member appointed by the minority leader of the 489
senate;490

       (4) Two members appointed by the speaker of the house of 491
representatives;492

       (5) One member appointed by the minority leader of the house 493
of representatives;494

       (6) One member appointed by the chief justice of the supreme 495
court.496

       (C) All members appointed to the commission shall possess 497
expertise, knowledge, or skills consistent with the purpose of the 498
commission, including personnel management, fiscal management, 499
economic analysis, and statistics.500

       (D) The following individuals are ineligible to serve on the 501
commission:502

       (1) An individual who has served in public office by 503
appointment or election within a year prior to the proposed 504
appointment to the commission;505

       (2) An incumbent by appointment or election to an office in 506
which the commission may make a salary recommendation;507

       (3) An individual employed as a legislative agent, retirement 508
system lobbyist, or executive agency lobbyist or an employer of a 509
legislative agent, retirement system lobbyist, or executive agency 510
lobbyist.511

       (E) Each member shall be appointed for a term of two years 512
and may be reappointed. Vacancies shall be filled in the manner 513
provided for the original appointment. Members may be removed or 514
replaced by the member's appointing authority.515

       (F) Each member shall serve without compensation but shall be 516
reimbursed for actual and necessary expenses incurred in the 517
performance of official duties. 518

       (G) The commission may employ staff and contract with 519
consultants with expertise in the field of compensation. The 520
commission shall be appropriated funds necessary to carry out 521
these tasks. 522

       (H) The legislative service commission shall provide 523
facilities and staff support for the commission. 524

       (I) Except as provided in section 195.05 of the Revised Code, 525
the commission shall convene every other year starting in 2022.526

       Sec. 195.02. The Ohio public officials compensation advisory 527
commission shall recommend the salaries of elected officials in 528
the form of pay schedules. The commission shall consider any 529
matter related to proper compensation of elected officials and 530
shall recommend any compensation package or structure the 531
commission finds to be appropriate. In determining the salaries to 532
be recommended in the pay schedules and additional compensation 533
amounts, the commission shall do all of the following:534

       (A) Review the statutes that establish the current salaries 535
of elected officials and their additional compensation amounts;536

       (B) Consider the length of time since the last salary or 537
additional compensation amount of an elected official was last 538
adjusted;539

       (C) Take into consideration both of the following changes 540
that have occurred since the salary or additional compensation 541
amount of an elected official was last adjusted:542

       (1) Any changes in the consumer price index prepared by the 543
United States bureau of labor statistics for urban wage earners 544
and clerical workers;545

       (2) Any changes in tax laws applicable to an elected 546
official.547

       (D) Consider the salaries paid to elected officials in other 548
states that are comparable to this state in terms of the 549
following:550

       (1) Population;551

       (2) Revenue and expenses per capita;552

       (3) Urban and rural diversity; 553

       (4) Federal salaries for similar positions;554

       (5) In the case of general assembly salaries, frequency of 555
legislative sessions.556

       (E) Review the laws of this state governing reimbursement of 557
expenses incurred by elected officials and take into consideration 558
the expenses incident to the office held, for which the elected 559
official is not reimbursed;560

       (F) Consider any other relevant factors that the commission 561
considers necessary to make its determination.562

       Sec. 195.03. (A) The Ohio public officials compensation 563
advisory commission shall make the recommendations for elected 564
officials pay schedules and additional compensation amounts in the 565
form of a resolution adopted by a simple majority of the 566
commission's members. The resolution shall include a listing of 567
elected officials' current salaries and additional compensation 568
amounts and the statutes reviewed by the commission.569

       (B) The commission shall prepare and adopt its initial 570
resolution not later than January 31, 2023, and subsequent 571
resolutions by January 31 of every other year thereafter. 572

       (C) The pay schedules and additional compensation amounts in 573
the commission's initial resolution shall be recommended to take 574
effect January 1, 2025, for state elected officials and January 1, 575
2024, for county elected officials.576

       Sec. 195.04.  The Ohio public officials compensation advisory 577
commission shall provide a copy of the resolution adopted under 578
section 195.03 of the Revised Code to the governor, president and 579
minority leader of the senate, speaker and minority leader of the 580
house of representatives, and chief justice of the supreme court. 581

       Sec. 195.05. (A) The Ohio public officials compensation 582
advisory commission shall reconvene to adopt a new resolution 583
recommending elected officials pay schedules and additional 584
compensation amounts if the general assembly:585

       (1) Does not adopt a resolution approving the resolution 586
adopted by the commission under section 195.04 of the Revised Code 587
by July 1 of the submission year; or588

       (2) Notifies the commission that changes to the schedules and 589
compensation amounts under the commission's resolution need to be 590
made in accordance with the general assembly's direction.591

       (B) The commission shall reconvene at one of the following 592
times:593

       (1) After July 1 of the submission year in the case the 594
general assembly does not act before that date to adopt a 595
resolution approving the commission's resolution;596

       (2) Within sixty days of receiving notice under division 597
(A)(1) of this section.598

       (C) The commission shall continue to reconvene to adopt a 599
resolution in accordance with sections 195.02 to 195.04 of the 600
Revised Code and divisions (A) and (B) of this section until the 601
general assembly adopts a resolution approving a resolution of the 602
commission.603

       (D) Elected official salaries shall not be altered in the 604
absence of a resolution adopted by the commission under section 605
195.04 of the Revised Code proposing the alterations that have 606
been approved by resolution of the general assembly.607

       Sec. 195.06. The governor shall consider a resolution adopted 608
by the general assembly approving a resolution adopted by the Ohio 609
public officials compensation advisory commission under section 610
195.04 of the Revised Code, and any statutory changes necessary to 611
implement the commission's resolution, when the governor proposes 612
the state budget under section 107.03 of the Revised Code.613

       Sec. 325.03.  Each county auditor shall be classified, for 614
salary purposes, according to the population of the county. All 615
county auditors shall receive annual compensation in accordance 616
with the following schedules and in accordance with section 325.18 617
of the Revised Code:618

       (B) In addition to the annual compensation that a sheriff 774
receives under this section for performing the duties of sheriff 775
prescribed by law, each sheriff shall receive in consideration of 776
the impact of Amended Substitute Senate Bill No. 2 of the 121st 777
general assembly on the workload of the sheriff, an additional 778
amount equal to one-eighth of the annual compensation that the 779
sheriff receives under division (A) of this section and section 780
325.18 of the Revised Code. This additional compensation shall be 781
paid biweekly from the county treasury if adequate funds have been 782
appropriated by the general assembly. If adequate funds have been 783
appropriated by the general assembly for the purposes of this 784
section, not later than the fifteenth day of March and September 785
of each year, the attorney general shall reimburse the fiscal 786
officer of the county the amount of additional compensation paid 787
under this division, the related amount of employer contributions 788
made under Chapter 145. of the Revised Code as required by the 789
public employees retirement board, and the related amount of the 790
payments to the social security administration for employer 791
contributions for Medicare part A. The fiscal officer shall 792
deposit the revenue in the county treasury.793

       Sec. 325.08.  Each clerk of the court of common pleas shall 794
be classified, for salary purposes, according to the population of 795
the county. All clerks of the court of common pleas shall receive 796
annual compensation in accordance with the following schedules and 797
in accordance with section 325.18 of the Revised Code:798

       (B) A prosecuting attorney in a county with a population of 1005
one million one or more who does not engage in the private 1006
practice of law shall receive in calendar year 2017 and in each 1007
calendar year thereafter annual compensation in an amount equal to 1008
the total compensation paid to a judge of the court of common 1009
pleas of that county pursuant to sections 141.04 and 141.05 of the 1010
Revised Code for the same calendar year, reduced by one hundred 1011
dollars.1012

       (C) A prosecuting attorney shall not engage in the private 1013
practice of law unless before taking office the prosecuting 1014
attorney notifies the board of county commissioners of the 1015
intention to engage in the private practice of law.1016

       A prosecuting attorney may elect to engage or not to engage 1017
in the private practice of law before the commencement of each new 1018
term of office, and a prosecuting attorney who engages in the 1019
private practice of law who intends not to engage in the private 1020
practice of law during the prosecuting attorney's next term of 1021
office shall so notify the board of county commissioners. A 1022
prosecuting attorney who elects not to engage in the private 1023
practice of law may, for a period of six months after taking 1024
office, engage in the private practice of law for the purpose of 1025
concluding the affairs of private practice of law without any 1026
diminution of salary as provided for in division (A) of this 1027
section and in section 325.18 of the Revised Code.1028

       (C)(D) As used in this section, "salary" does not include any 1029
portion of the cost, premium, or charge for health, medical, 1030
hospital, dental, or surgical benefits, or any combination of 1031
those benefits, covering the prosecuting attorney and paid on that 1032
person's behalf by a governmental entity.1033

       Sec. 325.14.  (A) Each county engineer shall be classified, 1034
for salary purposes, according to the population of the county. 1035
All county engineers shall receive annual compensation in 1036
accordance with the following schedules and in accordance with 1037
section 325.18 of the Revised Code:1038

       Such salary may be paid monthly out of the general county 1120
fund or out of the county's share of the fund derived from the 1121
receipts from motor vehicle licenses, as distributed by section 1122
4501.04 of the Revised Code, and the county's share of the fund 1123
derived from the motor vehicle fuel tax, as distributed by section 1124
5735.27 of the Revised Code, as the board of county commissioners 1125
directs, upon the warrant of the county auditor and shall be in 1126
lieu of all fees, costs, per diem or other allowances, and other 1127
perquisites, of whatever kind, which any engineer collects and 1128
receives. The engineer shall be the county tax map draftperson, 1129
but shall receive no additional compensation for performing the 1130
duties of that position. When the engineer performs service in 1131
connection with ditches or drainage works, the engineer shall 1132
charge and collect the per diem allowances or other fees provided 1133
by law and shall pay all of those allowances and fees, monthly, 1134
into the county treasury to the credit of the general county fund. 1135
The engineer shall pay into the county treasury all allowances and 1136
fees collected when the engineer performs services under sections 1137
315.28 to 315.34 of the Revised Code.1138

       (B) A county engineer may elect to engage or not to engage in 1139
the private practice of engineering or surveying before the 1140
commencement of each new term of office, and a county engineer who 1141
elects not to engage in the private practice of engineering or 1142
surveying may, for a period of six months after taking office, 1143
engage in the private practice of engineering or surveying for the 1144
purpose of concluding the affairs of private practice without any 1145
diminution of salary as provided in division (A) of this section 1146
and in section 325.18 of the Revised Code.1147

       Sec. 325.15.  (A) Each coroner shall be classified, for 1148
salary purposes, according to the population of the county. All 1149
coroners shall receive annual compensation in accordance with the 1150
following schedules and in accordance with section 325.18 of the 1151
Revised Code:1152

       (B) A coroner in a county with a population of one hundred 1218
seventy-five thousand one or more shall not engage in the private 1219
practice of medicine unless, before taking office, the coroner 1220
notifies the board of county commissioners of the intention to 1221
engage in that private practice.1222

       A coroner in a county with a population of one hundred 1223
seventy-five thousand one or more shall elect to engage or not to 1224
engage in the private practice of medicine before the commencement 1225
of each new term of office, and a coroner in such a county who 1226
engages in the private practice of medicine but who intends not to 1227
engage in the private practice of medicine during the coroner's 1228
next term of office shall so notify the board of county 1229
commissioners as specified in this division. For a period of six 1230
months after taking office, a coroner who elects not to engage in 1231
the private practice of medicine may engage in the private 1232
practice of medicine, without any reduction of the salary as 1233
provided in division (A) of this section and in section 325.18 of 1234
the Revised Code, for the purpose of concluding the affairs of the 1235
coroner's private practice of medicine.1236

       Sec. 325.18.  (A) As used in this section, "consumer price 1237
index" means the consumer price index prepared by the United 1238
States bureau of labor statistics (U.S. city average for urban 1239
wage earners and clerical workers: all items, 1982-1984=100) or, 1240
if that index is no longer published, a generally available 1241
comparable index.1242

       (B)(1) In calendar year 2003, the annual compensation amounts 1243
for county auditors under division (D) of section 325.03 of the 1244
Revised Code shall be increased by first increasing the amounts by 1245
the percentage under division (B)(1)(a) of this section then 1246
further increasing them by the percentage under division (B)(1)(b) 1247
of this section. Such percentages are:1248

       (a) The lesser of three per cent or the percentage increase, 1249
if any, in the consumer price index from October 1, 2000, to 1250
September 30, 2001, rounded to the nearest one-tenth of one per 1251
cent;1252

       (b) The lesser of three per cent or the percentage increase, 1253
if any, in the consumer price index from October 1, 2001, to 1254
September 30, 2002, rounded to the nearest one-tenth of one per 1255
cent.1256

       (2) Each calendar year from 2004 through 2008, the annual 1257
compensation of each county auditor shall be increased by the 1258
lesser of the following:1259

       (a) Three per cent;1260

       (b) The percentage increase, if any, in the consumer price 1261
index over the twelve-month period that ends on the thirtieth day 1262
of September of the immediately preceding calendar year, rounded 1263
to the nearest one-tenth of one per cent.1264

       (C) EachIn calendar year from 2002 through 20082017 and in 1265
each calendar year thereafter, the annual compensation in the 1266
immediately preceding calendar year of each county auditor, county 1267
treasurer, sheriff, clerk of the court of common pleas, county 1268
recorder, county commissioner, prosecuting attorney, other than a 1269
prosecuting attorney described in division (B) of section 325.11 1270
of the Revised Code, county engineer, and coroner shall be 1271
increased by the lesser of the following:1272

       (1) Three per cent;1273

       (2) The percentage increase, if any, in the consumer price 1274
index over the twelve-month period that ends on the thirtieth day 1275
of September of the immediately preceding calendar year, rounded 1276
to the nearest one-tenth of one per cent.1277

       (D)(C) Notwithstanding this section and sections 325.06, 1278
325.11, 325.14, and 325.15 of the Revised Code, when computing a 1279
salary for any elected county officer under any of those sections, 1280
if the population range for the class under which the officer is 1281
to be compensated is not the same as the population range for that 1282
class for any other such elected county office, the class at which 1283
the officer's salary is determined shall be the highest class at 1284
which any officer from that same county is compensated under the 1285
population range applicable to that officer.1286

       Sec. 505.24. Each(A) In calendar year 2015, each township 1287
trustee is entitled to compensation as follows:1288

       (A) Except as otherwise provided in division (B) of this 1289
section,in an amount for each day of service in the business of 1290
the township, to be paid from the township treasury as follows:1291

       (1) In townships having a budget of two hundred fifty 1292
thousand dollars or less, twentythirty-seven dollars and 1293
sixty-one cents per day for not more than two hundred days;1294

       (2) In townships having a budget of more than two hundred1295
fifty thousand but not more than onefive hundred thousand 1296
dollars, twenty-fourforty-three dollars and fifty-five cents per 1297
day for not more than two hundred days;1298

       (3) In townships having a budget of more than onefive1299
hundred thousand but not more than twoseven hundred fifty 1300
thousand dollars, twenty-eightforty-six dollars and fifty1301
nineteen cents per day for not more than two hundred days;1302

       (4) In townships having a budget of more than twoseven1303
hundred fifty thousand but not more than one million five hundred 1304
thousand dollars, thirty-threefifty-two dollars and 1305
seventy-eight cents per day for not more than two hundred days;1306

       (5) In townships having a budget of more than one million1307
five hundred thousand but not more than seventhree million five1308
hundred fifty thousand dollars, thirty-fivefifty-eight dollars 1309
and six cents per day for not more than two hundred days;1310

       (6) In townships having a budget of more than seventhree 1311
million five hundred fifty thousand but not more than onesix1312
million five hundred thousand dollars, fortysixty-three dollars 1313
and thirty-three cents per day for not more than two hundred days;1314

       (7) In townships having a budget of more than onesix million 1315
five hundred thousand but not more than threeten million five 1316
hundred thousand dollars, forty-foureighty-two dollars and seven 1317
cents per day for not more than two hundred days;1318

       (8) In townships having a budget of more than threeten1319
million five hundred thousand dollars but not more than six 1320
million dollars, forty-eightone hundred five dollars and 1321
fifty-one cents per day for not more than two hundred days;1322

       (9) In townships having a budget of more than six million 1323
dollars, fifty-two dollars per day for not more than two hundred 1324
days.1325

       (B) Beginning inIn calendar year 19992016 and in each 1326
calendar year thereafter, the amounts paid as specified in 1327
division (A) of this section shall be replaced by the following 1328
amounts:1329

       (1) In calendar year 1999, the amounts specified in division 1330
(A) of this section increased by three per cent;1331

       (2) In calendar year 2000, the amounts determined under 1332
division (B)(1) of this section increased by three per cent;1333

       (3) In calendar year 2001, the amounts determined under 1334
division (B)(2) of this section increased by three per cent;1335

       (4) In calendar year 2002, except in townships having a 1336
budget of more than six million dollars, the amounts determined 1337
under division (B)(3) of this section increased by three per cent; 1338
in townships having a budget of more than six million but not more 1339
than ten million dollars, seventy dollars per day for not more 1340
than two hundred days; and in townships having a budget of more 1341
than ten million dollars, ninety dollars per day for not more than 1342
two hundred days;1343

       (5) In calendar years 2003 through 2008, the amounts 1344
determined under division (B) of this section forin the 1345
immediately preceding calendar year shall be increased by the 1346
lesser of the following:1347

       (a)(1) Three per cent;1348

       (b)(2) The percentage increase, if any, in the consumer price 1349
index over the twelve-month period that ends on the thirtieth day 1350
of September of the immediately preceding calendar year, rounded 1351
to the nearest one-tenth of one per cent;1352

       (6) In calendar year 2009 and thereafter, the amount 1353
determined under division (B) of this section for calendar year 1354
2008.1355

       As used in division (B) of this section, "consumer price 1356
index" has the same meaning as in section 325.18 of the Revised 1357
Code.1358

       (C) Whenever members of a board of township trustees are 1359
compensated per diem and not by annual salary, the board shall 1360
establish, by resolution, a method by which each member of the 1361
board shall periodically notify the township fiscal officer of the 1362
number of days spent in the service of the township and the kinds 1363
of services rendered on those days. The per diem compensation 1364
shall be paid from the township general fund or from other 1365
township funds in such proportions as the kinds of services 1366
performed may require. The notice shall be filed with the township 1367
fiscal officer and preserved for inspection by any persons 1368
interested.1369

       By unanimous vote, a board of township trustees may adopt a 1370
method of compensation consisting of an annual salary to be paid 1371
in equal monthly payments. If the office of trustee is held by 1372
more than one person during any calendar year, each person holding 1373
the office shall receive payments for only those months, and any 1374
fractions of those months, during which the person holds the 1375
office. The amount of the annual salary approved by the board 1376
shall be no more than the maximum amount that could be received 1377
annually by a trustee if the trustee were paid on a per diem basis 1378
as specified in this division, and shall be paid from the township 1379
general fund or from other township funds in such proportions as 1380
the board may specify by resolution. Each trustee shall certify 1381
the percentage of time spent working on matters to be paid from 1382
the township general fund and from other township funds in such 1383
proportions as the kinds of services performed. A board of 1384
township trustees that has adopted a salary method of compensation 1385
may return to a method of compensation on a per diem basis as 1386
specified in this division by a majority vote. Any change in the 1387
method of compensation shall be effective on the first day of 1388
January of the year following the year during which the board has 1389
voted to change the method of compensation.1390

       Sec. 507.09.  (A) Except as otherwise provided in division 1391
(D) of this sectionIn calendar year 2015, the township fiscal 1392
officer shall be entitled to compensation as follows:1393

       (1) In townships having a budget of two hundred fifty 1394
thousand dollars or less, threeten thousand fiveone hundred 1395
sixty-one dollars;1396

       (2) In townships having a budget of more than two hundred1397
fifty thousand but not more than onefive hundred thousand 1398
dollars, fivethirteen thousand five hundredsixty-four dollars;1399

       (3) In townships having a budget of more than onefive1400
hundred thousand but not more than twoseven hundred fifty 1401
thousand dollars, sevenfourteen thousand sevenfive hundred 1402
fifteen dollars;1403

       (4) In townships having a budget of more than twoseven1404
hundred fifty thousand but not more than one million five hundred 1405
thousand dollars, nineseventeen thousand ninefour hundred 1406
nineteen dollars;1407

       (5) In townships having a budget of more than one million1408
five hundred thousand but not more than seventhree million five1409
hundred fifty thousand dollars, eleventwenty thousand three 1410
hundred twenty-one dollars;1411

       (6) In townships having a budget of more than seventhree 1412
million five hundred fifty thousand but not more than onesix1413
million five hundred thousand dollars, thirteentwenty-one1414
thousand twoseven hundred seventy-three dollars;1415

       (7) In townships having a budget of more than onesix million 1416
five hundred thousand but not more than threeten million five 1417
hundred thousand dollars, fifteentwenty-four thousand fournine1418
hundred eighty-eight dollars;1419

       (8) In townships having a budget of more than threeten1420
million five hundred thousand dollars but not more than six 1421
million dollars, sixteentwenty-eight thousand fivenine hundred 1422
nine dollars;1423

       (9) In townships having a budget of more than six million 1424
dollars, seventeen thousand six hundred dollars.1425

       (B) In calendar year 2016 and in each calendar year 1426
thereafter, the compensation paid in the immediately preceding 1427
calendar year shall be increased by the lesser of the following:1428

       (1) Three per cent;1429

       (2) The percentage increase, if any, in the consumer price 1430
index over the twelve-month period that ends on the thirtieth day 1431
of September of the immediately preceding calendar year, rounded 1432
to the nearest one-tenth of one per cent.1433

       As used in division (B) of this section, "consumer price 1434
index" has the same meaning as in section 325.18 of the Revised 1435
Code.1436

       (C) Any township fiscal officer may elect to receive less 1437
than the compensation the fiscal officer is entitled to under 1438
division (A) or (B) of this section. Any township fiscal officer 1439
electing to do this shall so notify the board of township trustees 1440
in writing, and the board shall include this notice in the minutes 1441
of its next board meeting.1442

       (C)(D) The compensation of the township fiscal officer shall 1443
be paid in equal monthly payments. If the office of township 1444
fiscal officer is held by more than one person during any calendar 1445
year, each person holding the office shall receive payments for 1446
only those months, and any fractions of those months, during which 1447
the person holds the office.1448

       A township fiscal officer may be compensated from the 1449
township general fund or from other township funds based on the 1450
proportion of time the township fiscal officer spends providing 1451
services related to each fund. A township fiscal officer must 1452
document the amount of time the township fiscal officer spends 1453
providing services related to each fund by certification 1454
specifying the percentage of time spent working on matters to be 1455
paid from the township general fund or from other township funds 1456
in such proportions as the kinds of services performed.1457

       (D) Beginning in calendar year 1999, the township fiscal 1458
officer shall be entitled to compensation as follows:1459

       (1) In calendar year 1999, the compensation specified in 1460
division (A) of this section increased by three per cent;1461

       (2) In calendar year 2000, the compensation determined under 1462
division (D)(1) of this section increased by three per cent;1463

       (3) In calendar year 2001, the compensation determined under 1464
division (D)(2) of this section increased by three per cent;1465

       (4) In calendar year 2002, except in townships having a 1466
budget of more than six million dollars, the compensation 1467
determined under division (D)(3) of this section increased by 1468
three per cent; in townships having a budget of more than six 1469
million but not more than ten million dollars, nineteen thousand 1470
eight hundred ten dollars; and in townships having a budget of 1471
more than ten million dollars, twenty thousand nine hundred 1472
dollars;1473

       (5) In calendar year 2003, the compensation determined under 1474
division (D)(4) of this section increased by three per cent or the 1475
percentage increase in the consumer price index as described in 1476
division (D)(7)(b) of this section, whichever percentage is lower;1477

       (6) In calendar year 2004, except in townships having a 1478
budget of more than six million dollars, the compensation 1479
determined under division (D)(5) of this section for the calendar 1480
year 2003 increased by three per cent or the percentage increase 1481
in the consumer price index as described in division (D)(7)(b) of 1482
this section, whichever percentage is lower; in townships having a 1483
budget of more than six million but not more than ten million 1484
dollars, twenty-two thousand eighty-seven dollars; and in 1485
townships having a budget of more than ten million dollars, 1486
twenty-five thousand five hundred fifty-three dollars;1487

       (7) In calendar years 2005 through 2008, the compensation 1488
determined under division (D) of this section for the immediately 1489
preceding calendar year increased by the lesser of the following:1490

       (a) Three per cent;1491

       (b) The percentage increase, if any, in the consumer price 1492
index over the twelve-month period that ends on the thirtieth day 1493
of September of the immediately preceding calendar year, rounded 1494
to the nearest one-tenth of one per cent;1495

       (8) In calendar year 2009 and thereafter, the amount 1496
determined under division (D) of this section for calendar year 1497
2008.1498

       As used in this division, "consumer price index" has the same 1499
meaning as in section 325.18 of the Revised Code.1500

       Sec. 3501.12. (A) The annual compensation of members of the 1501
board of elections shall be determined on the basis of the 1502
population of the county according to the next preceding federal 1503
census, and shall be paid monthly out of the appropriations made 1504
to the board and upon vouchers or payrolls certified by the 1505
chairperson, or a member of the board designated by it, and 1506
countersigned by the director or in the director's absence by the 1507
deputy director. Upon presentation of any such voucher or payroll, 1508
the county auditor shall issue a warrant upon the county treasurer 1509
for the amount thereof as in the case of vouchers or payrolls for 1510
county offices and the treasurer shall pay such warrant.1511

       (A) Except as provided in divisions (B) and (C) of this 1512
section(B) In calendar year 2014, the amount of annual 1513
compensation of memberseach member of the board of elections1514
shall be as follows:1515

       (1) Eighty-fiveNinety-two dollars and eighty-nine cents for 1516
each full one thousand of the first one hundred thousand 1517
population;1518

       (2) FortyForty-four dollars and fiftytwenty-six cents for 1519
each full one thousand of the second one hundred thousand 1520
population;1521

       (3) Twenty-twoTwenty-four dollars and four cents for each 1522
full one thousand of the third one hundred thousand population;1523

       (4) SixSeven dollars and seventy-fivethirty-seven cents for 1524
each full one thousand above three hundred thousand population.1525

       (B) Except as provided in division (C) of this section(C) In 1526
calendar year 2014, the compensation of a member of the board 1527
shall not be less than three thousand threesix hundred 1528
seventy-fiveeighty-seven dollars and shall not exceed twenty1529
twenty-one thousand eight hundred fifty-five dollars annually.1530

       (C) In calendar year 2001, the annual compensation of each 1531
member of the board shall be computed after increasing the dollar 1532
amounts specified in divisions (A) and (B) of this section by 1533
three per cent.1534

       (D) In calendar year 2002, the annual compensation of each 1535
member of the board shall be computed after increasing by three 1536
per cent the dollar amounts used to compute the compensation of a 1537
member under division (C) of this section.1538

       (E) In calendar year 2003 and thereafter, the annual 1539
compensation of each member of the board shall be computed after 1540
increasing by three per cent the dollar amounts used to compute 1541
the compensation of a member under division (D) of this section1542

       (D) In calendar year 2015, the annual compensation of each 1543
member of the board shall be computed after increasing the dollar 1544
amounts specified in divisions (B) and (C) of this section by five 1545
per cent. Such compensation shall not be less than four thousand 1546
eight hundred thirty dollars.1547

       (E) In calendar year 2016, the annual compensation of each 1548
member of the board shall be computed after increasing the dollar 1549
amounts specified in division (D) of this section by five per 1550
cent. Such compensation shall not be less than six thousand 1551
dollars.1552

       (F) In calendar year 2017 and in each calendar year 1553
thereafter, the annual compensation in the immediately preceding 1554
calendar year of each member of the board shall be increased by 1555
the lesser of the following:1556

       (1) Three per cent;1557

       (2) The percentage increase, if any, in the consumer price 1558
index over the twelve-month period that ends on the thirtieth day 1559
of September of the immediately preceding calendar year, rounded 1560
to the nearest one-tenth of one per cent.1561

       As used in this section, "consumer price index" has the same 1562
meaning as in section 325.18 of the Revised Code.1563

       For the purposes of this section, members of boards of 1564
elections shall be deemed to be appointed and not elected, and 1565
therefore not subject to Section 20 of Article II of the Ohio 1566
Constitution.1567

       Section 2.  That existing sections 101.27, 141.011, 141.04, 1568
325.03, 325.04, 325.06, 325.08, 325.09, 325.10, 325.11, 325.14, 1569
325.15, 325.18, 505.24, 507.09, and 3501.12 of the Revised Code 1570
are hereby repealed.1571

       OPERATING EXPENSES - JUDICIARY/SUPREME COURT1594

       Of the foregoing appropriation item 005321, Operating 1595
Expenses - Judiciary/Supreme Court, up to $206,770 in each fiscal 1596
year may be used to support the functions of the State Criminal 1597
Sentencing Council.1598

       LAW-RELATED EDUCATION1599

       The foregoing appropriation item 005406, Law-Related 1600
Education, shall be distributed directly to the Ohio Center for 1601
Law-Related Education for the purposes of providing continuing 1602
citizenship education activities to primary and secondary 1603
students, expanding delinquency prevention programs, increasing 1604
activities for at-risk youth, and accessing additional public and 1605
private money for new programs.1606

       OHIO COURTS TECHNOLOGY INITIATIVE1607

       The foregoing appropriation item 005409, Ohio Courts 1608
Technology Initiative, shall be used to fund an initiative by the 1609
Supreme Court to facilitate the exchange of information and 1610
warehousing of data by and between Ohio courts and other justice 1611
system partners through the creation of an Ohio Courts Network, 1612
the delivery of technology services to courts throughout the 1613
state, including the provision of hardware, software, and the 1614
development and implementation of educational and training 1615
programs for judges and court personnel, and operation of the 1616
Commission on Technology and the Courts by the Supreme Court for 1617
the promulgation of statewide rules, policies, and uniform 1618
standards, and to aid in the orderly adoption and comprehensive 1619
use of technology in Ohio courts.1620

       CONTINUING JUDICIAL EDUCATION1621

       The Continuing Judicial Education Fund (Fund 6720) shall 1622
consist of fees paid by judges and court personnel for attending 1623
continuing education courses and other gifts and grants received 1624
for the purpose of continuing judicial education. The foregoing 1625
appropriation item 005601, Continuing Judicial Education, shall be 1626
used to pay expenses for continuing education courses for judges 1627
and court personnel. If it is determined by the Administrative 1628
Director of the Supreme Court that additional appropriations are 1629
necessary, the amounts are hereby appropriated.1630

       No money in Fund 6720 shall be transferred to any other fund 1631
by the Director of Budget and Management or the Controlling Board. 1632
Interest earned on money in Fund 6720 shall be credited to the 1633
fund.1634

       FEDERAL GRANTS1635

       The Federal Grants Fund (Fund 3J00) shall consist of grants 1636
and other moneys awarded to the Supreme Court (The Judiciary) by 1637
the United States Government or other entities that receive the 1638
moneys directly from the United States Government and distribute 1639
those moneys to the Supreme Court (The Judiciary). The foregoing 1640
appropriation item 005603, Federal Grants, shall be used in a 1641
manner consistent with the purpose of the grant or award. If it is 1642
determined by the Administrative Director of the Supreme Court 1643
that additional appropriations are necessary, the amounts are 1644
hereby appropriated.1645

       No money in Fund 3J00 shall be transferred to any other fund 1646
by the Director of Budget and Management or the Controlling Board. 1647
However, interest earned on money in Fund 3J00 shall be credited 1648
or transferred to the General Revenue Fund.1649

       ATTORNEY SERVICES1650

       The Attorney Services Fund (Fund 4C80), formerly known as the 1651
Attorney Registration Fund, shall consist of money received by the 1652
Supreme Court (The Judiciary) pursuant to the Rules for the 1653
Government of the Bar of Ohio. In addition to funding other 1654
activities considered appropriate by the Supreme Court, the 1655
foregoing appropriation item 005605, Attorney Services, may be 1656
used to compensate employees and to fund appropriate activities of 1657
the following offices established by the Supreme Court: the Office 1658
of Disciplinary Counsel, the Board of Commissioners on Grievances 1659
and Discipline, the Clients' Security Fund, and the Attorney 1660
Services Division. If it is determined by the Administrative 1661
Director of the Supreme Court that additional appropriations are 1662
necessary, the amounts are hereby appropriated.1663

       No money in Fund 4C80 shall be transferred to any other fund 1664
by the Director of Budget and Management or the Controlling Board. 1665
Interest earned on money in Fund 4C80 shall be credited to the 1666
fund.1667

       COURT INTERPRETER CERTIFICATION1668

       The Court Interpreter Certification Fund (Fund 5HT0) shall 1669
consist of money received by the Supreme Court (The Judiciary) 1670
pursuant to Rules 80 through 87 of the Rules of Superintendence 1671
for the Courts of Ohio. The foregoing appropriation item 005617, 1672
Court Interpreter Certification, shall be used to provide 1673
training, to provide the written examination, and to pay language 1674
experts to rate, or grade, the oral examinations of those applying 1675
to become certified court interpreters. If it is determined by the 1676
Administrative Director that additional appropriations are 1677
necessary, the amounts are hereby appropriated.1678

       No money in Fund 5HT0 shall be transferred to any other fund 1679
by the Director of Budget and Management or the Controlling Board. 1680
Interest earned on money in Fund 5HT0 shall be credited to the 1681
fund.1682

       COUNTY LAW LIBRARY RESOURCES BOARD1683

       The Statewide Consortium of County Law Library Resources 1684
Boards Fund (Fund 5JY0) shall consist of moneys deposited pursuant 1685
to section 307.515 of the Revised Code into a county's law library 1686
resources fund and forwarded by that county's treasurer for 1687
deposit in the state treasury pursuant to division (E)(1) of 1688
section 3375.481 of the Revised Code. The foregoing appropriation 1689
item 005620, County Law Library Resources Board, shall be used for 1690
the operation of the Statewide Consortium of County Law Library 1691
Resources Boards. If it is determined by the Administrative 1692
Director of the Supreme Court that additional appropriations are 1693
necessary, the amounts are hereby appropriated.1694

        No money in Fund 5JY0 shall be transferred to any other fund 1695
by the Director of Budget and Management or the Controlling Board. 1696
Interest earned on money in Fund 5JY0 shall be credited to the 1697
fund.1698

       GRANTS AND AWARDS1699

       The Grants and Awards Fund (Fund 5T80) shall consist of 1700
grants and other money awarded to the Supreme Court (The 1701
Judiciary) by the State Justice Institute, the Division of 1702
Criminal Justice Services, or other entities. The foregoing 1703
appropriation item 005609, Grants and Awards, shall be used in a 1704
manner consistent with the purpose of the grant or award. If it is 1705
determined by the Administrative Director of the Supreme Court 1706
that additional appropriations are necessary, the amounts are 1707
hereby appropriated.1708

       No money in Fund 5T80 shall be transferred to any other fund 1709
by the Director of Budget and Management or the Controlling Board. 1710
However, interest earned on money in Fund 5T80 shall be credited 1711
or transferred to the General Revenue Fund.1712

       SUPREME COURT ADMISSIONS1713

       The foregoing appropriation item 005606, Supreme Court 1714
Admissions, shall be used to compensate Supreme Court employees 1715
who are primarily responsible for administering the attorney 1716
admissions program under the Rules for the Government of the Bar 1717
of Ohio, and to fund any other activities considered appropriate 1718
by the court. Moneys shall be deposited into the Supreme Court 1719
Admissions Fund (Fund 6A80) under the Supreme Court Rules for the 1720
Government of the Bar of Ohio. If it is determined by the 1721
Administrative Director of the Supreme Court that additional 1722
appropriations are necessary, the amounts are hereby appropriated.1723

       No money in Fund 6A80 shall be transferred to any other fund 1724
by the Director of Budget and Management or the Controlling Board. 1725
Interest earned on money in Fund 6A80 shall be credited to the 1726
fund.1727

       Section 4.  That existing Section 307.10 of Am. Sub. H.B. 59 1728
of the 130th General Assembly is hereby repealed.1729

       Section 5. All items in this section are hereby appropriated 1730
as designated out of any moneys in the state treasury to the 1731
credit of the designated fund. For all appropriations made in this 1732
act, those in the first column are for fiscal year 2014 and those 1733
in the second column are for fiscal year 2015. The appropriations 1734
made in this act are in addition to any other appropriations made 1735
for the FY 2014-FY 2015 biennium.1736

       LOCAL GOVERNMENT SALARY ASSISTANCE1742

        The foregoing appropriation item 911XXX, Local Government 1743
Salary Assistance, shall be used to reimburse counties and 1744
townships for the cost of providing pay raises to elected 1745
officials under this act. Townships and counties shall submit 1746
their requests for reimbursement to the Director of Administrative 1747
Services, who shall certify those reimbursable amounts. The 1748
Director of Administrative Services shall submit the certified 1749
amounts to the Controlling Board for approval and release under 1750
this appropriation item.1751

       Section 6. Within the limits set forth in this act, the 1752
Director of Budget and Management shall establish accounts 1753
indicating the source and amount of funds for each appropriation 1754
made in this act, and shall determine the form and manner in which 1755
appropriation accounts shall be maintained. Expenditures from 1756
appropriations contained in this act shall be accounted for as 1757
though made in the main appropriations act of the 130th General 1758
Assembly.1759

        The appropriations made in this act are subject to all 1760
provisions of the main appropriations act of the 130th General 1761
Assembly that are generally applicable to such appropriations.1762

       Section 7.  This act is an emergency measure necessary for 1763
the immediate preservation of the public peace, health, and 1764
safety. The reason for such necessity is to adjust the salaries of 1765
elected county officials and township trustees and fiscal officers 1766
elected for terms beginning 2015 and thereafter and the salaries 1767
of General Assembly members and statewide elected executive 1768
officers for terms beginning 2017 and thereafter. Therefore, this 1769
act goes into immediate effect.1770
