A BILL
To enact section 6109.25 of the Revised Code to 1
establish requirements and procedures pertaining 2
to levels of microcystin in public water systems.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 6109.25 of the Revised Code be 4
enacted to read as follows:5

       Sec. 6109.25.  (A) The director of environmental protection 6
shall adopt rules in accordance with Chapter 119. of the Revised 7
Code establishing both of the following:8

        (1) A level of microcystin in public water systems that 9
constitutes a threat to the health of persons using the water 10
based on best available science;11

       (2) Requirements and procedures governing testing of public 12
water systems for microcystin.13

       (B) A public water system located within the Lake Erie 14
watershed shall conduct testing for microcystin in accordance with 15
rules adopted under division (A) of this section. 16

       (C) If, at any time, water within a public water system 17
contains microcystin at a level exceeding the level established by 18
the director in rules adopted under division (A) of this section, 19
the owner or operator of the public water system shall so notify 20
the applicable board of health. The board of health shall notify 21
users and potential users of the water that the level of 22
microcystin is approaching a level that constitutes a threat to 23
the health of persons using the water. 24

       (D) As used in this section, "board of health" has the same 25
meaning as in section 3734.01 of the Revised Code.26
