       AN ACT authorizing the office of general services to convey certain land
         to the American Legion Post #1113
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The office of general services  is  hereby  authorized  and
    2  empowered  to  sell,  convey and transfer the real property described in
    3  section two of this act, to the American Legion Post #1113,  a  not-for-
    4  profit  corporation  in the state of New York, for the purpose of recre-
    5  ation, parking and other related purposes. Conveyance of said  lands  is
    6  to  be  made for $1.00 at such time and upon such other terms and condi-
    7  tions as the commissioner of general services  may  fix  and  determine,
    8  including  those  terms  and conditions described in section six of this
    9  act, and upon the written consent of the commissioner of the  office  of
   10  mental health.
   11    S  2.  Such  land  is more particularly described as follows: All that
   12  certain lot, piece or parcel of land, located off Mohawk Street, in  the
   13  village  of  Whitesboro, County of Oneida, State of New York and bounded
   14  and described as follows: Beginning at a point on the westerly  line  of
   15  the  Whitestown  American  Legion #1113 and the easterly line of the New
   16  York State Mental Health Office, said point being the following  courses
   17  from the northerly line of Main Street, N 70 50' 43' E, 253.05 feet to a
   18  point,  N  28 45' 19" W, 32.53 feet to a point and N 63 44' 53" E, 67.00
   19  feet to the point of beginning; Thence N 63 44' 53" E, 115.96 feet to  a
   20  point on the westerly line of Mohawk Street; Thence N 35 38' 18" E along
   21  said  street  96.14  feet  to a point on the easterly line of the Ablete
   22  Bird Sanctuary; Thence S 63 44' 16" W along said line 200.78 feet  to  a
   23  point; Thence S 26 15' 07" E, 45.00 feet to the point of beginning. This
   24  parcel of real property contains 7,152 square feet of land more or less.
   25  Being the premises described in a map and description for acquisition of
   26  real  property  from  Lawrence  S.  Rieben and Gertrude G. Rieben by the
   27  State of New York Office of Mental  Health  Community  Residence  Mohawk
   28  Valley  Psychiatric  Center, approved on April 12, 1990 and filed in the
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                             [ ] is old law to be omitted.

    1  Department of Transportation on April 23, 1990. This parcel  also  being
    2  the premises described in a deed from Lawrence S. Rieben and Gertrude G.
    3  Rieben,  reputed  owners  dated June 1, 1973, and recorded in the Oneida
    4  county  registrars office, Oneida County, as liber 1970 of deeds at page
    5  533.
    6    S 3. The description in sections two and seven  of  this  act  of  the
    7  lands to be conveyed are not intended to be a legal description, but are
    8  intended only to identify the premises to be conveyed. As a condition of
    9  purchase the American Legion Post #1113 shall submit to the commissioner
   10  of  general  services  for  his  or  her approval an accurate survey and
   11  description of the lands generally described in sections two  and  seven
   12  of this act, which may be used in the conveyance thereof.
   13    S 4. The office of general services shall not grant the aforesaid land
   14  unless  application  is made therefor by the American Legion Post #1113,
   15  within one year of the effective date of this act.
   16    S 5. Any lands transferred to the American Legion Post #1113  pursuant
   17  to  section one of this act shall be used exclusively for the purpose of
   18  recreation and parking by the American Legion Post #1113  of  Whitesboro
   19  and  upon  termination  of  such  use  of the lands so transferred shall
   20  revert to the State of New York.
   21    S 6. The American Legion Post #1113 located in the village of  Whites-
   22  boro,  Oneida  County  shall  transfer  and convey to the New York State
   23  Office of Mental Health a parcel of land as described in  section  seven
   24  of this act.
   25    S 7. Such land to be transferred and conveyed from the American Legion
   26  Post #1113 to the New York State Office of Mental Health is more partic-
   27  ularly  described as follows: All that parcel of land located off Mohawk
   28  Street in the Village of Whitesboro, County of Oneida, State of New York
   29  and described as follows: Beginning at a point on the westerly  line  of
   30  the  Whitestown  American  Legion #1113 and the easterly line of the New
   31  York State Mental Health Office, said point being N 70 50' 43' E, 253.05
   32  feet from the northerly line of Main Street; Thence  N  28  45'  19"  W,
   33  32.53  feet to a point and N 63 44' 53" E, 67.00 feet to a point; Thence
   34  S 27 23' W, 73.19 feet to the point of beginning. This  parcel  of  real
   35  property  contains  1,089  square  feet of land more or less.  Being the
   36  premises described in deed from Alice B.  Waterbury  to  the  Whitestown
   37  Post/1113, The American Legion dated September 27, 1951, and recorded in
   38  the Oneida county registrars office, Oneida County, as the liber 1336 of
   39  deeds at pages 193-196.
   40    S 8. This act shall take effect immediately.
