SYNOPSIS

     Amends Constitution to authorize tax exemptions for increased property values resulting from property improvements to facilitate use and access of homes by permanently and totally disabled.

A Concurrent Resolution proposing to amend Article VIII, Section 1 of the Constitution of the State of New Jersey.

 

     Be It Resolved by the Senate of the State of New Jersey (the General Assembly concurring):

 

     1.    The following proposed amendment to the Constitution of the State of New Jersey is hereby agreed to:

 

PROPOSED AMENDMENT

 

     Amend Article VIII, Section 1, by adding a new paragraph 8 to read as follows:

     8.    The Legislature may enact laws providing for the exemption from taxation of all or part of the increase in the valuation of real property upon which a dwelling house is located which results from improvements designed to facilitate the use and accessibility of the dwelling house by a permanently and totally disabled person who is the owner and resident of the house, or who is a member of the owner's household and resides therein.  Any law enacted pursuant to this paragraph shall provide for reimbursement from the State to any taxing district that sustains a loss in revenue because of implementation of this paragraph.

 

     2.    When this proposed amendment to the Constitution is finally agreed to pursuant to Article IX, paragraph 1 of the Constitution, it shall be submitted to the people at the next general election occurring more than three months after the final agreement and shall be published at least once in at least one newspaper of each county designated by the President of the Senate, the Speaker of the General Assembly and the Secretary of State, not less than three months prior to the general election.

 

     3.    This proposed amendment to the Constitution shall be submitted to the people at that election in the following manner and form:

     There shall be printed on each official ballot to be used at the general election, the following:

     a.  In every municipality in which voting machines are not used, a legend which shall immediately precede the question, as follows:

     If you favor the proposition printed below make a cross (X), plus (+), or check (T) in the square opposite the word "Yes."  If you are opposed thereto make a cross (X), plus (+) or check (T) in the square opposite the word "No."

     b.    In every municipality the following question:


 

 

CONSTITUTIONAL AMENDMENT PROVIDING FOR TAX EXEMPTIONS ON IMPROVEMENTS TO HOMES OF DISABLED PERSONS

Shall the amendment of Article VIII, Section I of the Constitution, authorizing the Legislature to enact laws providing for State-funded exemptions from property taxation of all or part of the increase in value of residential property resulting from improvements made  to facilitate the use of the property by a permanently and totally disabled person who resides on the property and  is the owner or a member of the household of the owner of the property, be approved?

 

 

INTERPRETIVE STATEMENT

 

NO

This proposed Constitutional amendment authorizes the Legislature to enact laws providing property tax exemptions for the increase in value of a home  improved in order to make use of the home easier for a permanently and totally disabled homeowner  or a member of the homeowner's household.  The State would be required to reimburse for any losses in local revenue that result.

 

 

STATEMENT

 

     This resolution proposes to amend the State Constitution to authorize the Legislature to enact laws authorizing State-funded tax exemptions for increased property values resulting from property improvements to facilitate the use and access of homes by the permanently and totally disabled.
