     Concerns access to records of wages for prevailing wage public work projects.

An Act concerning records of wages for prevailing wage public work projects and amending P.L.1963, c.150.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 5 of P.L.1963, c.150 (C.34:11-56.29) is amended to read as follows:

     5.    a.  Every contractor and subcontractor shall keep an accurate record showing the name, craft or trade, and actual hourly rate of wages paid to each worker employed by him in connection with a public work and such records shall be preserved for two years from date of payment. The record shall be open at all reasonable hours to the inspection of the public body awarding the contract, to any other party to the lease or agreement to lease pursuant to which the public work is done, and to the commissioner.

     b.    Every contractor and subcontractor shall forward a copy of the record required pursuant to subsection a. of this section to the public body awarding the contract for public work no later than five days from the date the contractor or subcontractor paid wages in connection with the public work. The public body shall keep a copy of the record open at all reasonable hours to the inspection of any member of the public and those records shall be preserved for two years from the date of receipt by the public body.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill increases access to wage records in connection with public work subject to the "New Jersey Prevailing Wage Act," P.L.1963, c.150 (C.34:11-56.25 et seq.). Currently, every contractor or subcontractor must keep records detailing the name, craft or trade, and hourly rate of wages paid to each worker employed in connection with a public work project. The contractor or subcontractor must keep the records open at all reasonable hours to the inspection of the public body awarding the contract for the public work, to any other party to the lease or agreement to lease pursuant to which the public work is done, and to the Commissioner of Labor and Workforce Development.

     This bill provides that the contractor or subcontractor, in addition to keeping and allowing access to wage records as required by current law, must also forward a copy of the records to the public body awarding the contract for public work no later than five days from the date the contractor or subcontractor paid wages in connection with the public work. The bill also requires the public body to keep the records open at all reasonable hours to the inspection of any member of the public and preserve the records for at least two years from the date of receipt.
