SYNOPSIS

     Requires court appearance for certain motor vehicle offenses that occur in school zone.

An Act concerning the adjudication of certain motor vehicle offenses and supplementing chapter 5 of Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding any other provision of law to the contrary, a court appearance may not be waived for a motor vehicle moving violation or parking offense that occurs in a school zone.

     b.    As used in this section:

     "Motor vehicle moving violation" means any violation of the motor vehicle laws of this State for which motor vehicle points are assessed by the Chief Administrator of the Motor Vehicle Commission pursuant to section 1 of P.L.1982, c.43 (C.39:5-30.5);

     "Parking offense" means a parking offense as defined in subsection c. of section 2 of P.L.1985, c.14 (C.39:4-139.3);

     "School zone" means a school zone as defined in R.S.39:1-1.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would require a court appearance for persons who commit moving violations or parking offenses in school zones. Under current law, court appearances can often be waived for parking offenses and many moving violations.

     The purpose of the bill is to further deter people from violating the motor vehicle laws of this State in school zones by requiring them to appear in court if charged.
