     Revises requirements for private investigator identification cards.

An Act concerning private detective identification cards and amending P.L.1939, c.369.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 10 of P.L.1939, c.369 (C.45:19-17) is amended to read as follows:

     10.  For the purpose of identification of persons engaged in the conduct of a private detective business, or as a private detective or investigator, each such person shall carry and show when requested an identification card[, which shall be a white card 4 1/4" x 2 1/2", in the form hereinafter set forth, to be signed, in the case of a private detective or investigator by himself, and in the case of employees of a private detective business by the employer as follows:

   (1)  If the bearer be a private detective or investigator, as follows:

   THIS IS TO CERTIFY THAT .................. is licensed and bonded by the State of New Jersey as a private detective in pursuance to "An act to license and regulate the business of private detectives and private detective agencies, and providing penalties for violation of its provisions,"  and is vested with all authorities allowed him by law.

     2.    This act shall take effect on the first day of the fourth month after enactment, but the Superintendent of State Police may take any anticipatory action in advance as shall be necessary for the implementation of the act.

 

 

STATEMENT

 

     This bill requires the Superintendent of State Police, in consultation with the New Jersey Licensed Private Investigators, to prescribe the information contained on identification cards issued to private investigators.

     Under current law, private investigators in this State are required to carry an identification card pursuant to the provisions of the Private Detective Act of 1939 (P.L.1939, c.369 et seq.).  This law imposes strict requirements concerning the form and content of these identification cards.

     Under the bill, the superintendent would be responsible for prescribing the specific information to be included on these identification cards, but would be required to consult with the New Jersey Licensed Private Investigators Association in making this determination.  The superintendent currently is responsible for determining the form and content of identification cards issued to security officers and bounty hunters.

     There have been instances in which law enforcement officers have questioned the legitimacy of the credentials of private investigators.  The purpose of the bill is to allow the superintendent the flexibility to ensure that these identification cards accurately identify private investigators as the professionals they are to both law enforcement and the public, while allowing these private investigators to have input on that decision.
