SYNOPSIS
Requires municipal court judge to dismiss motor vehicle charges if accident was caused by medical condition of driver.

An Act concerning certain motor vehicle accidents and supplementing Title 39 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. In any case where the driver of a motor vehicle is involved in a motor vehicle accident and is cited for a violation of Title 39 of the Revised Statutes, the municipal court judge shall dismiss all charges filed against that driver if a physician certifies that the accident would not have occurred but for the existence or onset of a medical condition or illness in that driver.
b. As used in this section, "physician" means a physician as defined in section 5 of P.L.1939, c.115 (C.45:9-5.1).
c. The provisions of this section shall not be applicable to a person whose driver's license was suspended or revoked at the time of the motor vehicle accident.
2. This act shall take effect immediately.
STATEMENT
This bill requires a municipal court judge to dismiss any charges for a motor vehicle violation filed against the driver in certain motor vehicle accidents. Municipal court judges would be required to dismiss all charges if the a physician certifies that the accident would not have occurred except for the onset or existence of a medical condition in the driver.
The bill's provisions are not applicable to a person whose driver's license was revoked or suspended at the time of the accident.
