SYNOPSIS

     Requires person eligible for health care benefits from more than one public entity to choose coverage from only one.

An Act concerning the receipt of health care benefits from multiple public entities and supplementing P.L.1979, c.391 (C.18A:16-12 et seq.), Title 40A of the New Jersey Statutes, and P.L.1961, c.49 (C.52:14-17.25 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding the provisions of any other law to the contrary, a person holding an appointment, elective office or employment with a board of education who is eligible for health care benefits from more than one public entity because of other public appointment, office or employment, shall choose to receive health care benefits from only one public entity, and shall not accept any amount of money in consideration for filing a waiver of health care benefits.

 

     2.    Notwithstanding the provisions of any other law to the contrary, a person holding an appointment, elective office or employment with a political subdivision of the State or an instrumentality thereof who is eligible for health care benefits from more than one public entity because of other public appointment, office or employment, shall choose to receive health care benefits from only one public entity, and shall not accept any amount of money in consideration for filing a waiver of health care benefits.

 

     3.    Notwithstanding the provisions of any other law to the contrary, a person holding an appointment, elective office or employment with the State or an employer other than the State who is eligible for health care benefits from more than one public entity because of other public appointment, office or employment, shall choose to receive health care benefits from only one public entity, and shall not accept any amount of money in consideration for filing a waiver of health care benefits.

 

     4.    This act shall take effect on December 31 next following enactment.

 

 

STATEMENT

 

     This bill requires that any person holding an appointment, elective office or employment with the State or any other public employer who is eligible for health care benefits from more than one public entity, because of another public appointment, office or employment, choose to receive health care benefits from one public entity only.  In addition, the person may not accept any amount of money in consideration for filing a waiver of health care benefits.
