     Imposes moratorium on DHS transitions and transfers of residents of State developmental centers until certain conditions are met.

An Act concerning individuals with developmental disabilities and supplementing Title 30 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The Department of Human Services shall impose a moratorium on the transition of an individual with a developmental disability residing in a State developmental center to a new location at the developmental center, or the transfer of an individual with a developmental disability residing in the developmental center to a new residential placement, due to an impending closure of the developmental center, until the department prepares a comprehensive written closure plan as provided for in this section and posts the plan on the website of the department.

     b.    The comprehensive written closure plan shall include, but not be limited to, a requirement to maintain sufficient staffing resources and staffing ratios to ensure that the individuals with developmental disabilities remaining at the developmental center during implementation of a closure plan are provided with safe and appropriate care and medically and behaviorally appropriate living conditions.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill imposes a moratorium on the transition of a resident of a State developmental center to a new location at the developmental center, or the transfer of the resident to a new residential placement, because of an impending closure of the developmental center, until the Department of Human Services prepares and posts on its website a comprehensive written closure plan.  The plan is to include, but not be limited to, a requirement to maintain sufficient staffing resources and staffing ratios to ensure that the individuals with developmental disabilities remaining at the developmental center during implementation of a closure plan are provided with safe and appropriate care and medically and behaviorally appropriate living conditions.
