Senate Bill 2735

AN ACT TO PROVIDE THAT THE MISSISSIPPI DEPARTMENT OF CORRECTIONS MAY OPERATE A VISITATION PROGRAM FOR MARRIED OFFENDERS AND THEIR NONINCARCERATED SPOUSES; TO AUTHORIZE THE COMMISSIONER OF THE DEPARTMENT OF CORRECTIONS TO PROMULGATE RULES AND REGULATIONS FOR THE PROGRAM; TO PROVIDE THAT THE OFFENDER OR THE OFFENDER'S SPOUSE MUST PAY THE COSTS ASSOCIATED WITH THE PROGRAM; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Department of Corrections is authorized to operate a visitation program for married offenders and their spouses.  The purpose of this program is to allow an offender who is legally married according to the laws of this state to have private visits with his or her spouse.  The commissioner is authorized to adopt rules and regulations for the operation of this visitation program.  The offender or the offender's spouse must pay all costs associated with private spousal visits.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
