A bill to amend 1909 PA 279, entitled
"The home rule city act,"
by amending section 5h (MCL 117.5h), as amended by 1994 PA 313.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
5h. (1) Whether or not so provided in its charter, a city
may, by ordinance, regulate or prohibit public nudity within city
boundaries.
(2) As used in this section, "public nudity" means knowingly
or intentionally displaying in a public place, or for payment or
promise of payment by any person including, but not limited to,
payment or promise of payment of an admission fee, any individual's
genitals or anus with less than a fully opaque covering, or a
female individual's breast with less than a fully opaque covering
of
the nipple and areola. A Public
nudity does not include a
mother's
breastfeeding of her baby does not under any circumstances
constitute
nudity irrespective or
expressing breast milk regardless
of
whether or not the her
areola or nipple is covered visible
during
or incidental to the feeding.breastfeeding
or expressing of
breast milk.
Enacting section 1. This amendatory act does not take effect
unless all of the following bills of the 97th Legislature are
enacted into law:
(a) Senate Bill No.____ or House Bill No. 5678 (request no.

(b) Senate Bill No.____ or House Bill No. 5681 (request no.
05696'14).
(c) Senate Bill No.____ or House Bill No. 5679 (request no.
