Bill Title: Amends the Local Records Act. Provides that a unit of local government or a school district that maintains an Internet website shall maintain an electronic mail system. Requires that unit of local government or school district to maintain and provide an electronic mail address for each of its officials for use in the course of their official duties. Requires a unit of local government or school district to post to its website for the current calendar year the contact information, including an electronic mail address, for all elected and appointed officials. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement.

AMENDMENT TO SENATE BILL 3106
2 AMENDMENT NO. ______. Amend Senate Bill 3106 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Local Records Act is amended by adding
5Section 20 as follows:
6 (50 ILCS 205/20 new)
7 Sec. 20. Internet posting requirements.
8 (a) A unit of local government or school district that
9serves a population of less than 1,000,000 that maintains an
10Internet website other than a social media website or social
11networking website shall, within 90 days of the effective date
12of this amendatory Act of the 98th General Assembly, post to
13its website for the current calendar year a mechanism, such as
14a uniform single email address, for members of the public to
15electronically communicate with elected officials of that unit
16of local government or school district, unless such officials

1have an individual email address for that purpose.
2 (b) For the purposes of this Section "Internet website"
3shall not include any social media website, social networking
4website, or any other social media presence that a unit of
5local government or school district maintains.
6 (c) A hyperlink to the information required to be posted
7under this Section must be easily accessible from the unit of
8local government's or school district's home page.
9 (d) The postings required by this Section are in addition
10to any other posting requirements required by law or ordinance.
11 (e) No home rule unit may adopt posting requirements that
12are less restrictive than this Section. This Section is a
13limitation under subsection (i) of Section 6 of Article VII of
14the Illinois Constitution on the concurrent exercise by home
15rule units of powers and functions exercised by the State.
16 Section 90. The State Mandates Act is amended by adding
17Section 8.38 as follows:
18 (30 ILCS 805/8.38 new)
19 Sec. 8.38. Exempt mandate. Notwithstanding Sections 6 and 8
20of this Act, no reimbursement by the State is required for the
21implementation of any mandate created by this amendatory Act of
22the 98th General Assembly.".
