| 1 | AMENDMENT TO SENATE BILL 1843
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 1843 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Medical Practice Act of 1987 is amended by | ||||||
| 5 | changing Section 2 as follows:
| ||||||
| 6 | (225 ILCS 60/2) (from Ch. 111, par. 4400-2)
| ||||||
| 7 | (Section scheduled to be repealed on November 30, 2011)
| ||||||
| 8 | Sec. 2. Definitions. For purposes of this Act, the
| ||||||
| 9 | following definitions shall have the following meanings,
| ||||||
| 10 | except where the context requires otherwise:
| ||||||
| 11 | 1. "Act" means the Medical Practice Act of 1987.
| ||||||
| 12 | 1.5. "Chiropractic physician" means a person licensed to | ||||||
| 13 | treat human ailments without the use of drugs and without | ||||||
| 14 | operative surgery. Nothing in this Act shall be construed to | ||||||
| 15 | prohibit a chiropractic physician from providing advice | ||||||
| 16 | regarding the use of non-prescription products or from | ||||||
| |||||||
| |||||||
| 1 | administering atmospheric oxygen. Nothing in this Act shall be | ||||||
| 2 | construed to authorize a chiropractic physician to prescribe | ||||||
| 3 | drugs. | ||||||
| 4 | 2. "Department" means the Department of Professional | ||||||
| 5 | Regulation.
| ||||||
| 6 | 3. "Director" means the Director of Professional | ||||||
| 7 | Regulation.
| ||||||
| 8 | 4. "Disciplinary Action" means revocation,
suspension, | ||||||
| 9 | probation, supervision, practice modification,
reprimand, | ||||||
| 10 | required education, fines or any other action
taken by the | ||||||
| 11 | Department against a person holding a license.
| ||||||
| 12 | 5. "Disciplinary Board" means the Medical Disciplinary
| ||||||
| 13 | Board.
| ||||||
| 14 | 6. "Final Determination" means the governing body's
final | ||||||
| 15 | action taken under the procedure followed by a health
care | ||||||
| 16 | institution, or professional association or society,
against | ||||||
| 17 | any person licensed under the Act in accordance with
the bylaws | ||||||
| 18 | or rules and regulations of such health care
institution, or | ||||||
| 19 | professional association or society.
| ||||||
| 20 | 7. "Fund" means the Medical Disciplinary Fund.
| ||||||
| 21 | 8. "Impaired" means the inability to practice
medicine with | ||||||
| 22 | reasonable skill and safety due to physical or
mental | ||||||
| 23 | disabilities as evidenced by a written determination
or written | ||||||
| 24 | consent based on clinical evidence including
deterioration | ||||||
| 25 | through the aging process or loss of motor
skill, or abuse of | ||||||
| 26 | drugs or alcohol, of sufficient degree to
diminish a person's | ||||||
| |||||||
| |||||||
| 1 | ability to deliver competent patient
care.
| ||||||
| 2 | 9. "Licensing Board" means the Medical Licensing Board.
| ||||||
| 3 | 10. "Physician" means a person licensed under the
Medical | ||||||
| 4 | Practice Act to practice medicine in all of its
branches or a | ||||||
| 5 | chiropractic physician licensed to treat human
ailments | ||||||
| 6 | without the use of drugs and without
operative surgery.
| ||||||
| 7 | 11. "Professional Association" means an association or
| ||||||
| 8 | society of persons licensed under this Act, and operating
| ||||||
| 9 | within the State of Illinois, including but not limited to,
| ||||||
| 10 | medical societies, osteopathic organizations, and
chiropractic | ||||||
| 11 | organizations, but this term shall not be
deemed to include | ||||||
| 12 | hospital medical staffs.
| ||||||
| 13 | 12. "Program of Care, Counseling, or Treatment" means
a | ||||||
| 14 | written schedule of organized treatment, care, counseling,
| ||||||
| 15 | activities, or education, satisfactory to the Disciplinary
| ||||||
| 16 | Board, designed for the purpose of restoring an impaired
person | ||||||
| 17 | to a condition whereby the impaired person can
practice | ||||||
| 18 | medicine with reasonable skill and safety of a
sufficient | ||||||
| 19 | degree to deliver competent patient care.
| ||||||

| 21 | Section 99. Effective date. This Act takes effect upon | ||||||
| 22 | becoming law.".
| ||||||
