Bill Title: Creates the Accountable Care Organization Clinical Laboratory Testing Advisory Board Act. Provides that every accountable care organization providing diagnosis and treatment for patients in this State must establish an advisory board to consider and recommend guidelines or protocols for clinical laboratory testing. Provides that the membership of a clinical laboratory testing advisory board must include at least one physician who is legally affiliated with the accountable care organization and is a medical director of a clinical laboratory that is providing services for the accountable care organization. Provides that an advisory board may make recommendations to the accountable care organization's governing board for the adoption of guidelines or protocols with respect to clinical laboratory testing. Provides that nothing in the Act requires an accountable care organization's governing board to adopt a clinical laboratory testing guideline or protocol recommended by the accountable care organization's advisory board. Effective January 1, 2014.

1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5Accountable Care Organization Clinical Laboratory Testing
6Advisory Board Act.
7 Section 5. Definitions. In this Act:
8 "Advisory board" means a clinical laboratory testing
9advisory board established under this Act.
10 "Clinical laboratory testing" means any test or analysis
11performed in a clinical laboratory as defined in Section 2-103
12of the Illinois Clinical Laboratory and Blood Bank Act or that
13is otherwise subject to Section 353 of the Public Health
14Service Act (42 U.S.C. 263a).
15 Section 10. Advisory board required. Every accountable
16care organization providing diagnosis and treatment for
17patients in this State must establish an advisory board to
18consider and recommend guidelines or protocols for clinical
19laboratory testing.
20 Section 15. Advisory board membership. Every advisory
21board established under this Act must include in its membership

1at least one physician who:
2 (1) is legally affiliated with the accountable care
3 organization; and
4 (2) is a medical director, as defined in Section 2-104,
5 of a clinical laboratory that is providing services for the
6 accountable care organization.
7 Section 20. Advisory board functions.
8 (a) An advisory board may make recommendations to the
9accountable care organization's governing board for the
10adoption of guidelines or protocols for (i) clinical laboratory
11testing used for diagnostic purposes or disease management and
12(ii) pathologist consultation on episodes of care.
13 (b) An advisory board may recommend guidelines or protocols
14for clinical laboratory testing to ensure appropriate use of
15such testing.
16 Section 25. Adoption of advisory board recommendations.
17Notwithstanding the requirement of this Act to establish a
18clinical laboratory testing advisory board, nothing contained
19in this Act shall be construed to require an accountable care
20organization's governing board to adopt a clinical laboratory
21testing guideline or protocol recommended by the accountable
22care organization's advisory board.
23 Section 30. Application of Act. Nothing in this Act applies

1to an accountable care organization owned or operated by or
2affiliated with any of the following:
3 (1) The Cook County Health and Hospitals System.
4 (2) The University of Illinois.
5 (3) A hospital licensed under the Hospital Licensing
6 Act.
7 (4) A hospital affiliate as defined in the Hospital
8 Licensing Act.
9 Section 99. Effective date. This Act takes effect January
