S.F. _____ DIVISION I 1 STATE BOND REPAYMENT FUND 2 Section 1. STATE BOND REPAYMENT FUND. 3 1. Notwithstanding section 8.55, subsection 2, paragraph 4 “b”, if the Iowa economic emergency fund reaches its maximum 5 balance in the fiscal year beginning July 1, 2014, after the 6 designated portion of the excess moneys is transferred to the 7 taxpayers trust fund pursuant to section 8.55, subsection 2, 8 paragraph “a”, the next $60,050,000 is transferred to the state 9 bond repayment fund created in section 8.57F. 10 2. If the treasurer of state determines that the amount 11 transferred pursuant to subsection 1 is not sufficient to 12 defease or redeem the bonds specified in section 8.57F, 13 subsection 2A, as enacted by this division of this Act, and 14 to pay the costs relating to the defeasance or redemption, to 15 the entire extent that the bonds may be defeased or redeemed, 16 the treasurer of state may submit a written request to the 17 department of management that the department certify the 18 amount of the insufficiency as determined by the treasurer 19 of state. The request shall detail the information needed 20 by the department of management to determine whether the 21 department concurs with the treasurer of state’s determination. 22 Upon issuance of the department of management’s written 23 certification of the insufficiency amount, there is transferred 24 from the Iowa economic emergency fund, after the transfer made 25 pursuant to subsection 1 to the state bond repayment fund, 26 an amount equal to the insufficiency amount certified by the 27 department of management. The treasurer of state’s request, 28 any documents relating to the request, and the department 29 of management’s certification shall also be submitted to 30 the chairpersons and ranking members of the committees on 31 appropriations of the senate and house of representatives and 32 the legislative services agency at the time of submission or 33 certification. 34 3. To the extent the vision Iowa program bonds issued 35 -1- LSB 6182XC (16) 85 tm/jp 1/ 18
S.F. _____ pursuant to section 12.71 are defeased or redeemed by moneys 1 transferred or credited to the state bond repayment fund 2 created in section 8.57F, there is transferred to the rebuild 3 Iowa infrastructure fund from the revenue source otherwise 4 designated by law or existing practice for payment of the 5 vision Iowa program bonds, an amount equal to that which 6 otherwise would have been paid in connection with the vision 7 Iowa program bonds issued pursuant to section 12.71 from such 8 revenue source for the fiscal year beginning July 1, 2014, 9 and each fiscal year thereafter as provided in section 8.57, 10 subsection 5, paragraph “e”. 11 Sec. 2. Section 8.57F, Code 2014, is amended by adding the 12 following new subsection: 13 NEW SUBSECTION . 2A. The moneys credited to and available 14 in the fund for the fiscal year beginning July 1, 2014, are 15 appropriated to the treasurer of state for the defeasance or 16 redemption of the vision Iowa program bonds issued pursuant to 17 section 12.71 and for the costs relating to the defeasance or 18 redemption, to the extent the bonds can be defeased or redeemed 19 and costs paid within the amount appropriated. 20 Sec. 3. Section 8.57F, subsection 3, Code 2014, is amended 21 to read as follows: 22 3. Any bonds listed in subsection subsections 2 and 2A that 23 are not defeased or redeemed in accordance with this section 24 shall continue to be payable from their original payment 25 source. 26 Sec. 4. EFFECTIVE UPON ENACTMENT. This division of this 27 Act, being deemed of immediate importance, takes effect upon 28 enactment. 29 Sec. 5. APPLICABILITY. The section of this division of this 30 Act providing for transfer of moneys from the Iowa economic 31 emergency fund to the state bond repayment fund instead of the 32 general fund of the state applies to transfers made from the 33 Iowa economic emergency fund after the effective date of this 34 division of this Act. 35 -2- LSB 6182XC (16) 85 tm/jp 2/ 18

For a study to assess placement of sex offenders or 19 other hard-to-place persons in the state requiring the type 20 of personal and medical care provided by a nursing facility, 21 including salaries, support, maintenance, and miscellaneous 22 purposes: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 24 (1) From the moneys appropriated in this lettered 25 paragraph, the department of human services shall utilize a 26 request for proposals process to select a private entity to 27 study the implementation of facilities in other states that 28 provide care for sex offenders and other hard-to-place persons 29 needing the type of care provided by a nursing facility, to 30 develop projections of the need for this type of facility in 31 the state over the next twenty years, and to develop cost 32 projections and financing considerations for facility options 33 in the state. The department of human services shall issue 34 a request for proposals within thirty days after the date of 35 -5- LSB 6182XC (16) 85 tm/jp 5/ 18
S.F. _____ enactment of this division of this Act. 1 (2) The study and report following the conclusion of the 2 study shall include all of the following information: 3 (a) A summary of long-term care facilities operated in 4 other states for the purpose of caring for sex offenders or 5 other hard-to-place persons, whether the facility is operated 6 by a governmental entity or through a contract with a private 7 entity. The summary of the facilities shall include an 8 overview of ownership and operations, populations served, 9 financing sources and average costs per patient, public 10 financing limitations, security or staff training policies, and 11 other considerations deemed appropriate. The summary shall 12 focus on models that may be adaptable to Iowa. 13 (b) A projection of the number of persons in the state who, 14 in the next twenty years, would require the services of such a 15 facility due to sex offender status, a history of abusive or 16 violent behavior in previous nursing facility placements, or 17 other unmet psychiatric needs. 18 (c) An analysis of options for the state based on the 19 research of out-of-state models and projected need. The 20 analysis shall identify potential ownership structures and 21 public or private facility options, including an identification 22 of state-owned facilities that may be underutilized and could 23 be reconfigured. The analysis shall also include management 24 structures, whether public or private, potential sources of 25 revenue and limitations on those sources, the need for enhanced 26 security or staff training for safety, and other considerations 27 deemed appropriate. 28 (3) A report on the results of the study produced pursuant 29 to this lettered paragraph shall be submitted to the governor, 30 the general assembly, and the department of human services by 31 November 1, 2014. 32 (4) The departments of human services, corrections, 33 inspections and appeals, and aging, the state public defender, 34 the office of ombudsman, the office of the state long-term care 35 -6- LSB 6182XC (16) 85 tm/jp 6/ 18
S.F. _____ ombudsman, and the judicial branch shall provide information 1 for purposes of the study as requested by the private entity 2 conducting the study. However, any information which is 3 confidential shall continue to be maintained as confidential. 4 (5) Notwithstanding section 8.33, moneys appropriated in 5 this lettered paragraph that remain unencumbered or unobligated 6 at the close of the fiscal year for which appropriated shall 7 not revert but shall remain available for expenditure for the 8 purposes designated until the close of the succeeding fiscal 9 year. 10 c. For the public purpose of providing grants to community 11 mental health centers in accordance with this lettered 12 paragraph: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 800,000 14 The appropriation made in this lettered paragraph shall 15 be distributed as grants of $100,000 each to the nonprofit 16 community mental health centers designated by the department 17 under chapter 230A as of January 1, 2014. The grants shall 18 be used by the centers for the costs of implementing an 19 electronic health record system. The electronic health record 20 systems implemented pursuant to a grant shall comply with the 21 electronic health information provisions implemented pursuant 22 to section 135.156 and with the mental health and disabilities 23 services system central data repository implemented pursuant 24 to section 225C.6A and other data requirements under chapter 25 225C. Each recipient of a grant shall have the electronic 26 health record system fully operational on or before July 1, 27 2018. Notwithstanding section 8.33, moneys appropriated in 28 this lettered paragraph that remain unencumbered or unobligated 29 at the close of the fiscal year for which appropriated shall 30 not revert but shall remain available for expenditure for the 31 purposes designated until the close of the succeeding fiscal 32 year. 33 d. To be used for payment of verified costs for previously 34 uncompensated medical and surgical treatment provided during 35 -7- LSB 6182XC (16) 85 tm/jp 7/ 18

The 7 department shall also engage representatives of other portions 8 of the mental health system, including representatives of the 9 regional mental health and disability services system, the 10 state mental health institutes, the Iowa behavioral health 11 association, and the Iowa association of community providers. 12 The procedural issues addressed by the group shall include 13 but are not limited to the responsibility for data entry 14 and verification, timeliness of data entry, confidentiality 15 requirements associated with the data needed to ensure the 16 usefulness of the system, and key characteristics and capacity 17 information about the beds in the system. 18 (2) The department shall base the procurement requirements 19 on the recommendation option contained in the December 2013 20 report that projected the lowest annual maintenance and 21 operating costs than the other option. 22 (3) Notwithstanding section 8.33, moneys appropriated in 23 this lettered paragraph that remain unencumbered or unobligated 24 at the close of the fiscal year for which appropriated shall 25 not revert but shall remain available for expenditure for the 26 purposes designated until the close of the succeeding fiscal 27 year. 28 6. DEPARTMENT OF PUBLIC HEALTH 29 a. REPORTING. 5 1. On or before January 15 of each year, a state agency 6 that received an appropriation in this division of this 7 Act shall report to the legislative services agency and the 8 department of management the status of all projects completed 9 or in progress. The report shall include a description of the 10 project, the progress of work completed, the total estimated 11 cost of the project, a list of all revenue sources being used 12 to fund the project, the amount of funds expended, the amount 13 of funds obligated, and the date the project was completed or 14 an estimated completion date of the project, where applicable. 15 2. On or before December 31 of each year, a recipient 16 of moneys appropriated in this division of this Act for any 17 purpose shall report to the state agency to which the moneys 18 are appropriated the status of all projects completed or in 19 progress. The report shall include a description of the 20 project, the progress of work completed, the total estimated 21 cost of the project, a list of all revenue sources being used 22 to fund the project, the amount of funds expended, the amount 23 of funds obligated, and the date the project was completed or 24 an estimated completion date of the project, where applicable. 25 Sec. 10. REVERSION. For purposes of section 8.33, unless 26 specifically provided otherwise, unencumbered or unobligated 27 moneys from an appropriation made or amended in this division 28 of this Act shall not revert but shall remain available for 29 expenditure for the purposes designated until the close of 30 the fiscal year beginning July 1, 2017. However, if the 31 project or projects for which such appropriation was made or 32 amended are completed in an earlier fiscal year, unencumbered 33 or unobligated moneys shall revert at the close of that same 34 fiscal year. 35 -13- LSB 6182XC (16) 85 tm/jp 13/ 18
S.F. _____ Sec. 11. EFFECTIVE UPON ENACTMENT. This division of this 1 Act, being deemed of immediate importance, takes effect upon 2 enactment. 3 DIVISION III 4 RADON CONTROL IN SCHOOLS 5 Sec. 12. NEW SECTION . 280.30 Radon testing. 6 1. For purposes of this section, “short-term test” means 7 a test approved by the department of public health in which a 8 testing device remains in an area for not less than two days 9 and not more than ninety days to determine the amount of radon 10 in the air that is acceptable for human inhalation. 11 2. The board of directors of each public school district 12 may provide for short-term testing and retesting for radon gas 13 to be performed at each attendance center under its control 14 and following any new construction of an attendance center or 15 additions, renovations, or repairs to an attendance center. 16 3. a. The department of public health and the department 17 of education shall each adopt rules to jointly administer this 18 section. 19 b. In consultation with appropriate stakeholders, the 20 department of public health shall adopt rules establishing 21 standards for radon testing at attendance centers. Such 22 standards shall include but are not limited to training 23 requirements for persons to conduct such testing and best 24 practices for conducting such testing. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 This bill relates to state and local finances by making 29 transfers and appropriations. The bill is organized by 30 divisions. 31 STATE BOND REPAYMENT FUND. 32 The bill provides that if the Iowa economic emergency fund 33 reaches its maximum balance in the fiscal year 2014-2015, after 34 the designated portion of the excess moneys is transferred to 35 -14- LSB 6182XC (16) 85 tm/jp 14/ 18
S.F. _____ the taxpayers trust fund, the next $60,050,000 is transferred 1 to the state bond repayment fund. If the transferred moneys 2 are insufficient to defease or redeem the bonds and to pay the 3 costs relating to the defeasance or redemption, the treasurer 4 of state may submit a written request to the department 5 of management to certify the amount of the insufficiency. 6 Upon the issuance of a written certification, the certified 7 amount is transferred from the Iowa economic emergency fund 8 to the state bond repayment fund. To the extent the vision 9 Iowa program bonds are defeased or redeemed by moneys in the 10 state bond repayment fund, transfers are made to the rebuild 11 Iowa infrastructure fund from the revenue source otherwise 12 designated by law or existing practice for payment of the 13 vision Iowa program bonds, an amount equal to that which 14 otherwise would have been paid in connection with the bonds 15 from such revenue source for the fiscal year 2014-2015 and for 16 each fiscal year thereafter as provided in Code section 8.57. 17 The bill amends the state bond repayment fund to allow 18 moneys credited to and available in the fund to be used for the 19 defeasance or redemption of vision Iowa program bonds along 20 with costs related to the defeasance or redemption of such 21 bonds. 22 The division takes effect upon enactment. The provisions 23 relating to the transfer of moneys from the Iowa economic 24 emergency fund to the state bond repayment fund instead of the 25 general fund of the state applies to transfers made from the 26 Iowa economic emergency fund after the effective date of the 27 division of the bill. 28 MISCELLANEOUS APPROPRIATIONS. 29 The bill provides various new and amended appropriations for 30 FY 2013-2014. 31 The bill appropriates moneys to the department of 32 agriculture and land stewardship for the agricultural drainage 33 well water quality assistance fund; for the water quality 34 initiative fund; for deposit in the watershed improvement 35 -15- LSB 6182XC (16) 85 tm/jp 15/ 18
S.F. _____ fund, for soil and water conservation administration, the 1 conservation of soil and water resources, and the support of 2 soil and water conservation district commissioners; and for 3 support of the silos and smokestacks national heritage area. 4 The bill appropriates moneys to the department of cultural 5 affairs for the preservation of civil war muster rolls, for 6 the restoration of the grave of governor Samuel Merrill, for 7 the funding of an oral history of civil rights, and for the 8 planning, design, construction, and renovation of the state 9 historical building. 10 The bill appropriates moneys to the economic development 11 authority for the midwest United States-Japan conference, for 12 the strategic infrastructure program, and for the home base 13 Iowa initiative. 14 The bill makes a supplemental appropriation to the 15 department of human rights for the low-income home energy 16 assistance program. 17 The bill appropriates moneys to the department of human 18 services for the costs of compensatory education to address 19 certain reviews of special education of certain children 20 placed at the Iowa juvenile home conducted by the department 21 of education, for a study to assess placement of sex offenders 22 or other hard-to-place persons in the state requiring the type 23 of personal and medical care provided by a nursing facility, 24 for the public purpose of providing grants to community mental 25 health centers, for payment of verified costs for certain 26 previously uncompensated medical and surgical treatment to 27 individuals who met the eligibility requirements pursuant to 28 Code chapter 249J (IowaCare program) but were not members 29 of the expansion population pursuant to Code chapter 249J, 30 for expanding the usage of the earned income tax credit to 31 evaluate the need to assist low-income Iowans in preparing tax 32 returns for electronic filing, and for establishing an asset 33 verification system for certain individuals under the Medicaid 34 program, and for development and initial implementation of an 35 -16- LSB 6182XC (16) 85 tm/jp 16/ 18
S.F. _____ inpatient psychiatric bed tracking system. 1 The bill appropriates moneys to the department of public 2 health for providing grants to substance-related disorder 3 treatment providers and for providing reimbursement to public 4 school districts that conduct radon testing. 5 The bill appropriates moneys to the department of public 6 safety for the fire service training bureau for the purchase 7 of equipment. 8 The bill appropriates moneys to the Iowa judicial branch for 9 costs associated with the electronic document management system 10 and other technology-related projects. 11 The bill appropriates moneys to the state board of regents 12 for the Iowa flood center at the state university of Iowa, for 13 the advanced manufacturing center at the university of northern 14 Iowa, for the veterinary diagnostic laboratory at the college 15 of veterinary medicine at Iowa state university of science and 16 technology for the purchase of cancer-related equipment, for 17 construction, renovation, and related improvements for phase 18 II of the agricultural and biosystems engineering complex 19 at Iowa state university of science and technology, for the 20 renovation and related improvements to the dental science 21 building at the state university of Iowa, and for renovation 22 and related improvements for Bartlett hall at the university of 23 northern Iowa. These appropriations for the agricultural and 24 biosystems engineering complex, the dental science building, 25 and Bartlett hall replace appropriations made from the rebuild 26 Iowa infrastructure fund that are eliminated by the bill. 27 The bill appropriates moneys to the Iowa resources 28 enhancement and protection fund. 29 The bill amends prior appropriations to the state board of 30 regents from the rebuild Iowa infrastructure fund in 2011 Iowa 31 Acts, chapter 133. The bill eliminates appropriations made for 32 fiscal year 2014-2015. 33 The bill creates reporting requirements for appropriations 34 made in this division of the bill. 35 -17- LSB 6182XC (16) 85 tm/jp 17/ 18
