SENATE BILL NO. 262

AN ACT TO AMEND TITLE 15 OF THE DELAWARE CODE RELATING TO CAMPAIGN CONTRIBUTIONS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §8012, Title 15, Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 8012 Contribution limits generally

(h) If a candidate accepts contributions for an office and the candidate does not appear on either the next primary or general election ballot for that office, the election period shall not end until either the day of the primary election or December 31 immediately after the general election on which the candidate appears on the ballot, whichever shall first occur.If a contribution was in an amount larger than allowed for the office for which the candidate appears on the ballot, the excess contribution shall be returned to the donor.


SYNOPSIS

This Bill addresses the issue of exceeding maximum political contribution limits by collecting money to run for an office which the candidate drops out of the race for prior to the primary or general election and using that money and new contributions by many of the same contributors to fund the race for a different office.
