HOUSE JOINT RESOLUTION NO. 5

ESTABLISHING A CHILD WELFARE DATA SHARING TASK FORCE.



WHEREAS, the Department of Education (DOE), the Department of Services for Children, Youth & Their Families (DSCYF), and Family Court each have a direct impact on the welfare of children in Delaware; and

WHEREAS, in the performance of their duties, the Department of Education (DOE), the Department of Services for Children, Youth & Their Families(DSCYF), and Family Court each rely on their own data systems that contain information that is not shared between these entities; and

WHEREAS, by allowing access to certain data, each of these entities would be able to take a more holistic approach to their decision making thus enhancing the potential for improved outcomes for children throughout the State.

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives and the Senate of the 147th General Assembly of the State of Delaware, with the approval of the Governor, that a Child Welfare Data Sharing Task Force be established to study and make recommendations regarding data bases that should be shared between state agencies and the courts.

BE IT FURTHER RESOLVED that the Child Welfare Data Sharing Task Force shall be composed of the following members:

  1. The Chief Judge of Family Court or a designee therein who shall act as the Chairperson of the Task Force;
  2. An information specialist from the Family Court;
  3. A policy specialist from the Department of Education;
  4. An information systems specialist from the Department of Education;
  5. A policy specialist from the Department of Services for Children Youth and Their Families;
  6. An information specialist from the Department of Services for Children Youth and Their Families;
  7. A representative from the Department of Technology and Information;
  8. A representative from the Department of Justice;
  9. A representative from the Child Protection Accountability Commission;
  10. A member of the Delaware House of Representatives appointed by the Speaker of the House of Representatives;
  11. A member of the Delaware Senate appointed by the President Pro Tempore;
  12. A member of the Delaware House of Representatives appointed by the House Minority Leader; and
  13. A Member of the Delaware Senate appointed by the Senate Minority Leader.
  14. The Data Governance Coordinator of the P-20 Council.

BE IT FURTHER RESOLVED that the Task Force shall:

a)       Define the data elements that should be shared between the agencies and Family Court.

b)       Identify potential legal obstacles to the sharing of this data.

c)       Identify and develop regulatory requirements and security parameters that would allow for the sharing of data.

d)       Identify potential costs to the sharing of data.

e)     Determine the feasibility and cost of developing a student ID for every child born in Delaware.

f)     Make recommendations for the implementation of data sharing between the Family Court, the Department of Education, and the Department of Services for Children, Youth and Their Families.

BE IT FURTHER RESOLVED that House Minority staff will assist this Task Force.

BE IT FURTHER RESOLVED that the Task Force shall present a final report of its findings and recommendations to the Governor, the Speaker of the House of Representatives, and the President Pro Tempore of the Senate by October 31, 2013.
