HOUSE CONCURRENT RESOLUTION NO. 39

REQUESTING THE DELAWARE STATE BAR ASSOCIATION TO ESTABLISH AN INDEPENDENT BIPARTISAN COMMITTEE OF DELAWARE ATTORNEYS TO REVIEW AND RECOMMEND REVISIONS TO DELAWARE'S CAMPAIGN FINANCE LAWS.



WHEREAS, over the years there have been various issues raised as to the adequacy and effectiveness of Delaware's campaign finance laws; and

WHEREAS, properly controlling and enforcing campaign finance laws involves balancing the constitutional rights of individuals to freedom of speech and association with the concerns of undue and improper influence; and

WHEREAS, the Attorney General of the State of Delaware had Norman Veasey, former Chief Justice of the Supreme Court of the State of Delaware, review recent campaign finance violations and make some recommendations relating to such violations; and

WHEREAS, the General Assembly believes a comprehensive and full review of all campaign finance laws is needed.

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives of the 147th General Assembly of the State of Delaware, the Senate concurring therein, that the President of the Delaware State Bar Association is requested to appoint a bipartisan committee of the Association's members to undertake a comprehensive review of Delaware campaign finance laws and to make a report with recommendations to the Governor, President Pro-Tempore of the Senate, and the Speaker of the House of Representatives.

BE IT FURTHER RESOLVED that the report and recommendations shall be completed by January 1, 2015.

BE IT FURTHER RESOLVED that the committee shall be staffed by an attorney from each House and Senate caucus and clerical assistance by the House of Representatives as needed.

BE IT FURTHER RESOLVED that the Attorney General of the State of Delaware is requested to have a Deputy Attorney General available to advise and assist the committee as may be needed.


SYNOPSIS

This Concurrent Resolution requests the establishment of an independent bipartisan committee of Delaware attorneys to review and recommend revisions to Delaware's campaign finance laws with a report and recommendations due by January 1, 2015.
