HOUSE BILL NO. 348

AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO SURF FISHING.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fifths of all members elected to each house thereof concurring therein):

Section 1.Amend �4701(a)(5), Title 7 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(G)The Department may issue surf fishing vehicle plates numbered consecutively beginning with the numeral "1". The Department may set a fee for the surf fishing vehicle plates or may auction the plates for a fee based upon interest and demand for such vehicle plates.A person issued a numbered surf fishing vehicle plateshall be entitled to retain the plate as long as the person maintains a valid surf fishing vehicle permit.Upon receipt by the Department of information indicating that the surf fishing vehicle permit of any person issued a numbered plate is expired, the Department shall notify the plate holder to renew their permit or surrender the plate to the Division within 30 days.Any numbered plate issued to a person whose surf fishing vehicle permit is subsequently suspended or revoked, or not renewed within a period of sixty days after expiration, shall be forfeited and/or revoked immediately.

SYNOPSIS

This bill allows the Department of Natural Resources and Environmental Control to issue numbered surf fishing vehicle plates. The plates may be sold or auctioned for a fee.The numbered surf fishing vehicle plateis an option for people with an interest in having such a plate.The non-numbered surf fishing vehicle plates will still be available.
