HOUSE BILL NO. 238

AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO REGULATIONS AND PROHIBITIONS CONCERNING WILDLIFE.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §715, Title 7 of the Delaware Codeby making deletions as shown by strike through and insertions shown by underline and as follows:

§715 Possession of protected wildlife; prohibitions.

(a) No person shall have more than 2 times the daily bag limit or creel limit of any game bird, game animal or game fish in that person's possession at any 1 time when it is lawful to possess such wildlife;, except that possession limits for game birds protected under the Migratory Bird Treaty Act shall be defined by federal regulations. nothing in this section shall apply to rabbits lawfully killed outside of this State, or to muskrat lawfully taken, or to Any game bird, game animal, or game fish that has been processed and stored for consumption at a person's permanent residence shall not count against the person's possession limit.Nothing in this section shall apply to terrapin lawfully taken and of lawful size, when it is lawful to have said animals, their meat and skins in possession.

(d) Whoever violates this section shall be guilty of a class C environmental misdemeanor for each offense. In addition to being fined and/or imprisoned, the violator shall be fined $5.00 $25.00 for each game bird, game fish and game animal caught or killed illegally, purchased or offered to purchase, sold, offered for sale, bartered or exchanged, or taken or killed or found in possession in excess of the bag or creel limit.


SYNOPSIS

This bill adopts by reference federal migratory game bird possession limits established by federal regulation to provide more efficient and timely adoption of such changing regulations. This bill also clarifies that possession limits do not apply to game birds, animals or fish that have been transported to a permanent residence and processed and stored for consumption, removes archaic and irrelevant language relative to rabbit and muskrat possession, and increases the currently outdated monetary fine for violation of this section.
