HOUSE BILL NO. 107

AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO AN EXAMINATION OF BASIC SKILLS AND CLARIFYING ALTERNATIVES TO STUDENT TEACHING REQUIREMENTS FOR SPECIALISTS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §1202 of Title 14 of the Delaware Code by inserting a new definition at §1202(10) as follows and renumbering the remaining definitions accordingly:

"(10) "Specialist" means an educator, other than a teacher or administrator, licensed and certified by the State under this chapter to engage in other related professional support services. For purposes of this chapter, a specialist may include but is not limited to a school counselor, a school library media specialist, a school psychologist, a school social worker, or a school nurse.".

Section 2. Amend §1210(a) of Title 14 of the Delaware Code by deleting the period at the end of subparagraph (3) and inserting in lieu thereof "; or" and by adding thereafter a new subparagraph (4) as follows:

"(4) The applicant is applying for a license and certification as a specialist and completes supervised practical experience in the specialty area equivalent to student teaching.Equivalent practical experience in the specialty area recognized pursuant to rules and regulations promulgated and adopted pursuant to this chapter may include but is not limited to a supervised internship, a practicum, or clinical experience."

Section 3.Amend §1210 of Title 14 of the Delaware Code by deleting subsection (b) in its entirety and relettering the remaining subsections accordingly.

Section 4. Amend §1210 of Title 14 of the Delaware Code in the newly relettered subsection (e) by deleting "(a) and (c) through (e)" and inserting in lieu thereof "(a) through (d)".

Section 5.Amend §1210 of Title 14 of the Delaware Code in the newly relettered subsection (f) by deleting "(a), (b) and (d)" and inserting in lieu thereof"(a) and (c)".

Section 6.Amend §1260(a)(2) of Title 14 of the Delaware Code by deleting the "and" in the second sentence and inserting in lieu thereof "prior to participation in the program.Candidates must also pass".

Section 7. This Act does not affect any individual who applied for an initial license prior to the effective date.

Section 8.If any provision of this Act or the application of any section or part thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Act that can be given effect without the invalid provision or application.

Section 9. The provisions of this Act shall be effective upon its enactment into law.


SYNOPSIS

This Act requires that all applicants for educator licensure in Delaware achieve a passing score on an examination of general knowledge such as PRAXIS I, before being issued an initial license.The current law allows a grace period for the applicant to pass the examination after being issued an initial license. At present, all Delaware Teacher Preparation Programs require that prior to graduation students must pass PRAXIS I and, where applicable and available, pass PRAXIS II.This Act requires that ARTC Candidates must fulfill the PRAXIS I testing requirements prior to Program participation.This Act does not impact licensure requirements for applicants in a vocational trade and industry area (also referred to as Skilled and Technical Sciences teachers).This Act also permits recognition of alternative supervised practical experience in the licensure requirements for educator specialists whose preparation programs do not include the traditional student teaching component.
