Summary

This Bill provides for the transfer or assignment of permits and licenses for Delaware fisheries which are closed to new entrants. The recipients of the permits and licenses must have specified experience in commercial fishing in order for the transfer or assignment to occur. The assignment or transfer of permits does not prevent or restrict DNREC from managing the fisheries or otherwise regulating commercial fishing practices. A notification and review process is provided under which DNREC approves transfers and assignments. Commercial fisherman in Delaware with permits and licenses are generally self-employed with few if any employment benefits. A permit or license for a fishery which is closed to new entrants has market place value, and this legislation allows the license or permit holder to take advantage of that value at the time of retirement, disability, mental incapacity or death through transfer or assignment to another experienced commercial fisherman.
